RESOLUTION TO ENTER INTO AN AGREEMENT WITH THE
SEEDING SUBCONTRACTOR FOR THE WATER MAIN EXTENSION
UNDER UNION PACIFIC RAILROAD PROJECT TO COVER THE
SEEDING WARRANTY PERIOD
WHEREAS, the City Council of Fairfax, Iowa has contracted with Tschiggfrie
Excavating Co. for the Water Main Extension Under Union Pacific Railroad project; and
WHEREAS, Tschiggfrie Excavating Co. subcontracted with Soil Concepts, Inc. for the
seeding work; and
WHEREAS, Hall & Hall Engineers has recommended the City enter into an agreement
with Soil Concepts, Inc., to cover the seeding warranty period once the general contract with
Tschiggfrie Excavating Co. is closed out.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa, to enter into an agreement with the Water Main Extension Under Union Pacific Railroad
project seeding subcontractor, Soil Concepts, Inc., to cover the seeding warranty period.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute
said resolution.

Permanent Seeding Warranty
Supplemental Agreement
Water Main E�ension Under Union Pacific Railroad
Praject Na.: 6950-22-04
This warranty is to guarantee completed seeding areas at the Fairfax Water Main Extension Under Union Pacific
Railroad project site for a maximum period of 12 months from the date of project acceptance, July 9"', 2024. A
uniformly dense, live, and healthy stand of grass, ftee of weeds, deb�is, e�oded areas, bare spots, diseases, and
insects shal! be provided at the end of the warranty period (July 9�", 2025).
During the warranty period, any defects in the seeded areas (0.33 acres af SUDAS Type 1) shalt be corrected
and re-seeded until all affected areas are accepted by the Engineer. No additional compensation beyond the
warranty fee shal! be made. Repair costs are the Contractor's responsibility, except for those resulting from loss
or damage due to occupancy of the site by others, vandalism, civil disobedience, physical damage by animals,
vehicles, fire, or losses due to curtailment of water by local authority, or by "Acts of God".
Seeding and fertilizing work shall comply with Section 9010 of the SUDAS Standard Specifications.
IN WITNESS WHEREOF, the City of Fairfax, lowa and Soil Concepts, Inc. have signed this Supplemental
Agreement in duplicate. One cnunterpart each has been delivered to each party.
