A RESOLUTION TO ENTER INTO A SWIFT USER AGREEMENT WITH
LINN COUNTY RECORDER'S OFFICE
WHEREAS, the City of Fairfax, Iowa has documents to record at the Linn County
Recorder's Office; and
WHEREAS, the Linn County Recorder's Office is implementing new software to
electronically handle documents; and
WHEREAS, the Linn County Recorder's Office is requiring the City of Fairfax to enter
into a SWIFT User Agreement to use this new software while recording documents.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Fairfax, Iowa, that they approve entering into the SWIFT User Agreement with Linn County
Recorder's Office.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax, Iowa,
that the Mayor and City Clerk/Treasurer are hereby directed to certify this resolution of approval.

SWIFT User Agreement

lowa State Code 331.606(4} states that the Recorder "shall permanently archive an unaltered version of each
record document or instrument. A document or instrument may be archived in its original format, as an
electronic document, or in another format suitable for preserving information in the document or
instrument."
1 understand that upon demand, unless otherwise required by law, I have a right to have the original paper
instrument returned to me. I further understand that under lowa Law, an instrument recorded in an
electronic format is considered an electronic record.

Licensee understands they will have seven (7) days to open and download the electronic image. After seven
days the link will expire and a new link will need to be requested. They will have thirty (30) days to retrieve
their paper documents, at which point they will be shredded.
SWIFT user has opted for ail documents they submit to be returned in electronic format. The Swift user has
declined the option to have their paper document mailed back and grants permission for the county to shred
the original after thirty days have elapsed from the date of recording.
