The Mayor presided and the roll being called, the following meinbers of the Council were present and absent: � Present:� Tom Nurre Mike Daly Dan Wozniak Nick Volk and Marianne Wainwright Absent: None. The Mayor announced that an asnendinent to the boundaries of the Fairfax Urban Renewal Area had been prepared, along with an amendinent to the urban renewal plan for the areas, and that it was now necessary to set a date for a public hearing on the proposed ainended areas and pro�osed amendment to the urban renewal plan. Accordingly, Council Member Volk moved the adoption of the following resolution entitled "Resolution Setting Date for a Public Hearing on Designation of the Expanded Fairfax Urban Renewal Area and on Urban Renewal Plan Ainendznent," and the inotion was seconded by Council Meinber Nun-e. Following due consideration, the Mayor put the question on the inotion and the roll being called, the following named Council Members voted: Ayes: Nurre Daly Wozniak, Volk, and Wainwrigllt Nays: None. Whereupon, the Mayor declared the resolution duly adopted as follows: -1- DORSEY & WHITNEY LLP, ATTORNEYS, DES MOINES, IOWA 4870-3941-7310�2 Fair�:ix'4I9915-40;Sct Hrg UR Amcud RLSOLU'TION NO. 2024-66 RESOLUTION SETTING DATE FOR PIJBLIC HEARING ON DESIGNATION OF THE EXPANllED FAIRFAX URBAN RENEWAL AREA AND ON URBAN RENEWAL PLAN An1ENDMENT WHEREAS, this City Council of the City of Fairfax, Iowa (tlle "City") by resolution previously established the Fairfax Urban Renewal Area (the "Urbail Renewal Area") and adopted an urban renewal plan (ihe "Plan") for the govei-rlance of projects and initiatives therein; and WHEREAS, a proposal has becn inade which shows the desil-ability of expanding the Urban Renewal Area to add and include all the property (the "Property") lying within the legal description set out in Exhibit A; and WHEREAS, this City Council is desirous of obtaining as much infonnation as possible fi-ou1 the resideilts of the City before inaking this decision; and WHEREAS, an amendinent (the "Amendment") to the Plan has been prepared which (1) covers the addition of the Propei`ty to the Urban Renewal Area; and (2) authorizes the undertaking of new urban renewal projects in the Urban Renewa] Area consisting of (a) usillg tax increment financing to �ay the costs of planning, designin� and constructing street improvements; and (b) using tax inereinent financing to the pay the costs of planning, designing and constructing municipal watei-works system iinprovements; and WHEREAS, it is now necessary that a date be set for a public heai-ing on the designation of the expansion of the Urban Renewal Area and on the Ainendment; NOW, THEREFORE, Be It Resolved by the City Council of the City of Fairfax, Iowa, as follows: Section 1. This City Council will ineet at the Fairfax City Hall, 300 80t�' St Ct, Fairfax, Iowa, on October 8, 2024, at 6:00 p.m., at which tiine ai7d place it will hold a public hearing on the designation of the expanded Urban Renewal Area described in the preamble hei-eof and on the Amendment. Section 2. The City Clerk shall publish notice of said hearing, the same being in the applicable forin attached hereto, which publication shall be inade in a legal newspaper of general circulation in Fairfax, whieh publication shall be not less than four (4) and not inore than twenty (20) days before the date set for hearing. Section 3.
