A RESOLUTION TO ENTER INTO AN AGREEMENT WITH DAN BUSHMAN FOR
CONNECTION TO THE CITY OF FAIRFAX'S WATER MAIN SYSTEM AT LOT 1,
BUSHMAN FIRST ADDITION
WHEREAS, the Dan Bushman has requested to hook-up to the City of Fairfax's water
main system at Lot 1, Bushman First Addition to the City of Fairfax, Linn County, Iowa; and
WHEREAS, the City of Fairfax desires to have this site connected to the City's water main
system and has made improvements to the City's system with the 2021 Sanitary Sewer and Water
Main Extensions Project to make this possible; and
WHEREAS, the City of Fairfax has adopted Resolution No. 2022-92 establishing water
main connection fees relative to the 2021 Sanitary Sewer and Water Main Extensions Project.
NOW, THEREFORE, BE IT RESOLVED, that the City of Fairfax agrees to enter into
an agreement with Dan Bushman for connection to the City of Fairfax's water main system at Lot
l, Bushman First Addition to the City of Fairfax, Linn County, Iowa.
BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the Mayor
Pro Tempore and the City Clerk/Treasurer are hereby authorized and directed to execute said
Resolution.

AGREEMENT FOR WATER MAIN CONNECTION FEE
It is hereby agreed between the City of Fairfax, lowa (hereinafter referred to as the City)
and The Daniel S. Bushman Revocable Trust U/D/0 August 2, 2012 (hereinafter referred
to as the Owner) titleholder of the property described as follows:
Lot'1', Bushman First Addition to the City of Fairfax, Linn County, lowa
WHEREAS, the Owner hereby agrees to pay the City a water main connection fee
associated with the 2021 Sanitary Sewer and Water Main Extension Project; and
WHEREAS, the City has established the water main connection fee for the 2021 Sanitary
Sewer and Water Main Extension Project with Resolution No. 2022-92; and
WHEREAS, the City has established the water main connection fee for Lot 1 Bushman
First Addition based upon an average lot width of 559.14 LF, and that the Owner shall
connect their existing building to the City's water main facilities; and
WHEREAS, the 2023 water main connection fee for the above-mentioned property shall
be $18,742.37; and
WHEREAS, the City shall waive the tapping fee for connecting the proposed 8" diameter
water service to the City's water main, since the Owner had the 12" by 8" tee and gate
valve previously installed at no costs to the City; and
WHEREAS, The City has a State Water Excise Tax of 6.0% on Water Main Fees, Resulting
in a Tax amount of $1,124.54; and
WHEREAS, the total 2023 water main connection fee for the above-mentioned property
shall be $19,866.91.
The following conditions are a part of this agreement, and shall be applicable to this
property:
1. This Connection Fee shall be a one-time fee and shall be for one service connection
to the City's public water main for the property identified above.
2. This connection fee does not replace or diminish the City's water usage fee for this
property. The Owner, or their tenants, renters, etc. shall be responsible to pay their
water usage fee in a prompt and timely manner.
3. The Owner shall be fully responsible for extending their water service to the City's
public water main and for connecting to the City's public water main.
4. The Owner shall execute a Private Water Main Agreement prior to connecting to the
City's public water main facilities
5. The Owner shall coordinate with the City's maintenance / building department prior
to connecting the City's public water main.
6. The Owner shall follow the City's regulations for connecting to the City's public
water main.
7. This Agreement shall be binding upon all heirs, successors, and assigns of the Owner.
