A RESOLUTION TO ENTER INTO AN AGREEMENT WITH DAN BUSHMAN FOR
CONNECTION TO THE CITY OF FAIRFAX'S SANITARY SEWER SYSTEM AT LOT
1, BUSHMAN FIRST ADDITION
WHEREAS, the has requested to hook-up to the City of Fairfax's sanitary sewer system
at Lot l, Bushman First Addition to the City of Fairfax, Linn County, Iowa; and
WHEREAS, the City of Fairfax desires to have this site connected to the City's sanitary
sewer system and has made improvements to the City's system with the 2021 Sanitary Sewer and
Water Main Extensions Project to make this possible; and
WHEREAS, the City of Fairfax has adopted Resolution No. 2022-94 establishing sanitary
sewer connection fees relative to the 2021 Sanitary Sewer and Water Main Extensions Project.
NOW, THEREFORE, BE IT RESOLVED, that the City of Fairfax agrees to enter into
an agreement with Dan Bushman for connection to the City of Fairfax's sanitary sewer system at
Lot 1, Bushman First Addition to the City of Fairfax, Linn County, Iowa.
BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the Mayor
Pro Tempore and the City Clerk/Treasurer are hereby authorized and directed to execute said
Resolution.

AGREEMENT FOR SANITARY SEWER CONNECTION FEE
It is hereby agreed between the City of Fairfax, lowa (hereinafter referred to as the City)
and The Daniel S. Bushman Revocable Trust U/D/O August 2, 2012 (hereinafter referred
to as the Owner) titleholder of the property described as follows:
Lot'1', Bushman First Addition to the City of Fairfax, Linn County, lowa
WHEREAS, the Owner hereby agrees to pay the City a sanitary sewer connection fee
associated with Resolution No. 2022-94 Establishing Sanitary Sewer Connection Fees
Relative to the 2021 Sanitary Sewer and Water Main Extension Project; and
WHEREAS, the City has established the 2023 sanitary sewer connection fee from
Resolution No. 2022-94 for Lot 1 Bushman First Addition in the Amount of $1,817.81,
which is based upon the City's costs to install sanitary sewer pipe to said �ot 1, as well as
one year of interest; and
WHEREAS, The City has a State Sales Tax of 7.0% on Sanitary Sewer Fees, Resulting in a
Tax amount of $127.25; and
WHEREAS, the total 2023 sanitary sewer connection fee for the above-mentioned
property shall be $1,945.06.
The following conditions are a part of this agreement, and shall be applicable to this
property:
1. This connection fee shall be a one-time fee and shall be for one service connection
to the City's public sanitary sewer system for the property identified above.
2. This connection fee does not replace or diminish the City's wastewater (sewer)
usage fee for this property. The Owner, or their tenants, renters, etc. shall be
responsible to pay their wastewater usage fee in a prompt and timely manner.
3. The Owner shall be fully responsible for extending their sanitary sewer service to the
City's public sanitary sewer system and for connecting to the City's public sanitary
sewer system.
4. The Owner shall coordinate with the City's maintenance / building department prior
to connecting the City's public sanitary sewer system.
5. The Owner shall follow the City's regulations for connecting to the City's public
sanitary sewer system.
6. This Agreement shall be binding upon all heirs, successors, and assigns of the Owner.
