RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF APPROVING THE APPLICATION FOR ANNEXATION
FOR PROPERTY LOCATED EAST OF LEFEBURE ROAD AND NORTH OF
76TH AVENUE
WIIEREAS, Property Owners of land located in Linn County, Iowa and adjacent
to or near the City of Fairfax, Iowa have submitted applications to be annexed in to the
City of Fairfax; and
WHEREAS, the City of Fairfax, Iowa has filed these annexation applications on
June 5, 2023; and
WHEREAS, Iowa Code 368.7 requires a public hearing on the annexation
application before the City of Fairfax can approve or deny the application; and
WHEREAS, interested effected property owners, adjacent property owners, and
residents or taxpayers of the City of Fairfax having comments for or against this
annexation may appear and be heard at the public hearing at the City Council meeting on
August 8, 2023 at 6:00 PM at the Fairfax City Hall, at 300 80t" Street Court, Fairfax,
Iowa.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, that this confirms that the City Council order the publication of a notice of
public hearing pertaining to the application for the annexation of properties located east
of Lefebure Road and north of 76�' Avenue, into the City of Fairfax, Iowa not less than
ten (10) days nor more than twenty (20) days prior to the date set for the hearing.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.

ANNEXATION
TO: ALL CITIZENS OF FAIRFAX, IOWA AND LINN COUNTY, IOWA AND ALL
PERSONS OWING OR CLAIMING AN INTEREST THEREIN AND
TO: WHOM IT MAY CONCERN,
You are hereby notified that the City of Fairfax City Council has received and will consider
Applications for Voluntary annexation and will hold a public hearing before the Fairfax City
Council, at Fairfax City Hall, 300 80t" Street Court, in Fairfax, on Tuesday, August 8th, 2023 at 6:00
p.m., as listed below with attached Annexation Legal Description:

That S 1/2 of the SW 1/4 and the West'/2 of the SW 1/4 SE I/4, all in Section 15-82-8, Linn County,
Iowa, excepting that part of the SE I/4 SW 1/a in Section 15-82-8, Linn County, Iowa, described as
follows: Commencing at the South'/4 corner of Section 15-82-8 and continuing in a Westerly
direction 382 feet, thence North 88°49'40" a distance of 33 feet to the point of beginning. From the
point of beginning due North a distance of 323.98 feet, thence Westerly 91 ° 11' 15" a distance of
363.55 feet to a point, thence Southerly 88°48'45" a distance of 322.92 feet to a point that is 33 feet
North of the South quarter line, thence Easterly along a line parallel to the South quarter line a
distance of 363.55 feet to the point of beginning.
And
The West 1/2 of the SE'/4 excepting therefrom the West 1/2 of the SW I/4 of the SE 1/4 Section 15-82-8,
Linn County, Iowa;
And
All that part of the SW '/4 of the NE '/4lying South of the Right of Way of the C.M. & St. P. Ry. Co.
Section 15-82-8, Linn County, Iowa except that part described as follows: Commencing at the SW
corner of the SW I/4 of the NE'/4 of said Section 15; thence North 02°22'S4" West 272.94 feet along
the West line of the SW 1/4 of the NE 1/4 of said Section 15 to the point of beginning; thence
continuing North 02°22'S4" West 120.02 feet along the said West line to South right-of-way line of
the Cedar Rapids and Iowa City Railway Company; thence North 88°35'S2" East 1325.16 feet
along said South right-of-way line to the said �ast line of the SW 1/a of the NE I/a of said Section 15;
thence South 02°38'48" East 120.03 feet along said East line; thence South 88°35'S2" West 1325.71
feet to the point of beginning. For the purpose of this description, the South line of the NE 1/4 of said

Quarter (SW'/4) of Section Fifteen (15), Township Eighty-two (82) North, Range Eight (8) West of
the Fifth (5) P.M., Linn County, Iowa.
76th Avenue
The North Half of 76th Avenue lying adjacent and contiguous to the South Half (S.1/2) Southwest
Quarter (SW 1/4) and the Southwest Quarter of the Southeast Quarter (SW 1/4-SE 1/4) of Section
Fifteen (15), Township Eighty-two (82) North, Range Eight (8) West of the Fifth (5) P.M., Linn
County, Iowa.
