WHEREAS, Iowa Land & Building Co. (a subsidiaiy of Alliant I.�nergy) (hei-eatter
"Applicant") has submitted an application to the Ciry of Tairfax for the voluntaiy anneaation
into the City of Fair��ax of approximately 164.58 acres of land that it now owns in
unincorporated Linn County.
WHEREAS, Applicant (a subsidiai-y ofAlliant Energy) has subtnitted an application to
the City of Cedar Kapids for the voluntary annexation in the City of Cedar Rapids of
approximately 245 acres of land that it now owns in unincorporated Linn County.
WHEREAS, Applicant has affirrnatively stated the pi-operty whicl� it intends to annex
into the City of Fairfax will be zoned and utilized for LI ("Light Industrial") uses with
�noderate needs in the way of electricity and water usage.
WHEREAS, Applicant has inade representations that the property it intends to a�zne�
into the City of Ceda�- Rapids will be zoned for HI("�Ieavy Industrial") to include
manuf�ch�ring uses that will require a water supply between 15 to 120 MGD (million gallons
per day).
WHEREAS, to the extent tl7at Applicant intends to i•ely upon the Silurian Aquifer to
meet its water supply needs, the City o�FT'airfax has concerns about the ability of the Sihu�ian
Aquifer to satisfy those water needs while at the same time meeting the existing water needs
of the City of Fairfax and other commtmities within Johnson County and Linn County that
also rely upon the Silurian Aquifer for thell- water needs both now and into the fiitu��e.
NOW THCRCFOI2�, I3E IT �1:�R�I3Y RESOLVED BY TH� CITY COUNCIL
OF THE CITY OF FAIRFAX, IOWA, that the City's professional staff, to include its City
Clerk/Treasurer, City Engineer, and City Attorney, are hereby authorized to engage state
regulatoi•s; appi-opriate counties; and cities, as well as any entities v��ho are lalowledgeable
about the Silurian Ac�uife�•. The goal of these interactions is to share the City of Faiz•fax's
concerns as to how this limited v��ater resource (the Siluri�n Aquifei-) will be regulated now and
into the firttu�e.
