RESOLUTION GRANTING PROPERTY OWNERS THE RIGHT TO
ESTABLISH AND COLLECT SANITARY SEWER AND WATER MAIN
CONNECTION FEES FOR PUBLIC SANITARY SEWER AND WATER
MAIN FACILITIES THAT THEY EXTEND TO SERVE THEIR
PROPERTY
WHEREAS, the City of Fairfax has previously established sanitary sewer and water main
connection fees which are collected by the City of Fairfax to offset the costs to the City for
extending public sanitary sewer and water main facilities that serve these properties; and
WHEREAS, The Fairfax City Council would like to grant property owners the right to
establish and collect sanitary sewer and water main connection fees to other properties that will be
served by their extension of the public sanitary sewer and water main facilities; and
WHEREAS, said sanitary sewer and water main connection fees shall be proportionate to
the area and/or property frontage in which it serves; and
WHEREAS, said sanitary sewer and water main fees shall be established based upon the
property owners' costs to extend the public sanitary sewer and water main to serve their property;
and
WHEREAS, The City of Fairfax shall review, approve, and administer all sanitary sewer
and water main connection fees for the extension of the public sanitary sewer and water main
infrastructure by property owners.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa, to grant property owners the right to establish and collect sanitary sewer and water main
connection fees for public sanitary sewer and water main facilities that they extend to serve their
property.
BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that
the Mayor and City Clerk are hereby authorized and directed to execute this Resolution.
