RESOLUTION TO ENTER INTO AN AGREEMENT WITH THE
SEEDING SUBCONTRACTOR FOR THE 2023 WATER MAIN
EXTENSION UNDER PRAIRIE CREEK PROJECT TO COVER THE
SE�DING WARRANTY PERIOD
WHEREAS, the City Council of Fairfax, Iowa has contracted with Midwest
Underground Contractors, Inc. for the 2023 Water Main Extension Under Prairie Creek project;
and
WHEREAS, Midwest Underground Contractors, Inc. subcontracted with Soil
Concepts, Inc. for the seeding work; and
WHEREAS, Hall & Hall Engineers has recoimnended the City enter into an agreement
with Soil Concepts, Inc., to cover the seeding war�•anty period once the general contract with
Midwest Underground Contractors, Inc. is closed otiit.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa, to enter into an agreement with the 2023 Water Main Extensions Under Praii•ie Creek
project seeding subcontractor, Soil Concepts, Inc., to cover the seeding warranty period.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute
said resolution.

Permanent Seeding Warranty
Suppiemental Agreement
2023 Water Main Extension Under Prairie Creek
Project No.: 6950-22-04
This warranty is to guaranfee completed seeding areas at the Fairfax Water Main Extension Under Prairie Creek
projecf site for a maximum period of 12 months from the date of project acceptance, September 12�h, 2023. A
uniformly dense, five, and healfhy stand of grass, free of weeds, debris, eroded areas, bare spats, diseases, and
insects sha!! be provided at the end of the warranty period (September 12'", 2024).
During the warranty period, any defects in the seeded areas as bid (4.11 acres of Sl1DAS 7ype 9 and 0.15 acres
of SUDAS Type 2) shall be corrected and re-seeded until all affected areas are accepted by the Engineer. No
additional compensation beyond the warranty fee si�all be made. Repair costs are the Contractor's responsibility,
except for fhose ��esulting from loss or damage due to occupancy of the site by others, vandalism, civil
disobedience, physical damage by animals, vehicles, fire, or losses due to curtailme�}t of water by local authority,
or by "Acts of Gad".
Seeding and fertilizing work shall cornply with Section 9010 of #he SUDAS Standard Specifications.
IN WITNESS WHEREOF, the City of Fairfax, lowa and Soil Concepts, Inc. have signed this Supplemental
Agreement in dupiicate. One counterpart �ach has been delivered to each party.
