RESOLUTION TO ENTER INTO AN AGREEMENT WITH THE PUMP
HOUSE SEEDING SUBCONTRACTOR TO COVER THE REMAINDER
OF THE SEEDING WARRANTY PERIOD
WHEREAS, the City of Fairfax, Iowa has contracted with Kleiinan Construction, Inc.
for the 2020 Puinp House & Site Improvements project; and
WHEREAS, Kleiinan Construction, Inc. subcontracted with Soil Concepts, Inc. for the
seeding work; and
WHEREAS, Hall & Hall Engineers has recommended the City cnter into an agreemeilt
with the Soil Concepts, Inc., to cover the remainder of the seeding warranty period after the
general contract with Kleiinan Construction, Inc. is closed out.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Faii•fax,
Iowa, to enter into an agreeinent with the Puinp House seeding subcontractor, Soil Concepts,
Inc., to cover the reinainder of the seeding warranty period.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute
said resolution.

SuppEemental Agreemeni
2020 Pump House & Site Improvements
Project Na.: 6950-19-03
This warranty is to guaran#ee cotnpleted seeding areas at the Fairfax Pump House site for a m�ximum pei�ioci of
12 manihs from the date of initial acceptance, which occurred May 31, 2021. A uniformiy dense, live, and healthy
sfand of grass, free of weeds, debris, eroded areas, bare spots, diseases, and insects shalE be provided af the
end of fhe warranfy period (May 31, 2022).
During the warranty periad, any defects in the o�-iginal seeded area (4,0 acres) shall be corrected and re-seeded
unfil all affected areas are accepted by the Engineer. No additional compensatian beyond the wan�anty fee shall
be mad�. Repair costs are the Cantractor's responsibility, except for those resulting from loss or damage due to
accupancy of the site by others, vandalisrn, civil disobedience, physical damage by animals, vehicles, fire, or
iosses due to curtailment of wa#er by focal authority, or by "Acts of God".
Seeding and fertilizing work shall comply with Section 90�0 of fhe SUDAS Standard Specifications.
IN WITNESS WHER�OF, the City of Fairfax, lowa and Soil Concapts, Inc. have signed this Supplemental
Agreemeiit in duplicate. One counterpart each has been delivered to each party.
