RESOLUTION TO ENTER INTO AN AGREEMENT WITH THE
SEEDING SUBCONTRACTOR FOR THE 2021 SEWER & WATER
MAIN EXTENSIONS PROJECT TO COVER THE REMAINDER OF
THE SEEDING WARRANTY PERIOD
WHEREAS, the City of Fairfax, Iowa has contracted with Schrader Excavating &
Grading Co. for the 2021 Sanitaiy Sewer & Water Main Extensions project; and
WHEREAS,. Schrader Excavating & Grading Co. subcontracted with Soil Concepts,
Inc. for the seeding work; and
WHEREAS, Hall & Hall Engineers has recosmnended the City enter into an agreement
with the Soil Concepts, Inc., to cover the reinainder of the seeding warranty period after the
geileral contract with Sclu-ader Excavating & Gradiilg Co. is closed out.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa, to enter into aiz agreeinent with the 2021 Sanitary Sewer & Water Main Extensions
seeding subcontractor, Soil Conce�ts, Inc., to cover the remainder of the seeding wai7-anty
period.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute
said resolution.

Permanent Seeding Warranty
Supplemental Agreement
2023 Sanitary Sewer & Water Main Extensions
Project No.: 6950-20-02
This warranty is to guarantee compfeted seeding areas at th� Fairfax Sanitary Sewer & Water Main Extensions
project site for a maximum period of 12 months from the date of project acceptance, May 10, 2Q22. A uniformly
dense, live, and heaithy stand oP grass, free of weeds, debris, erocied areas, bare spots, diseases, and insects
shali be provided at the end of the warranty period (May �0, 2023).
During the warranty periad, any defecfs in the original seeded area (2.85 acres of SUDAS Type 1 and 4.32 acres
of SUDAS Type 2} sha►f be corrected and re-seeded until ail affected areas are accepted by the Engineer. No
additionai compensation beyond fhe warranty fee shall be made. Repair costs are the C�nlractor's responsibility,
except for those resulting from loss or damage due to accupancy of the site by oEhers, vandalism, civi!
disobedience, physical damage by animals, vehicles, fire, or losses due to curfaifinent of water by local authority,
or by "Acts of Gad".
Seeding and fertilizing work shall camply with Section 9010 of the SUDAS Standarci Specifications.
IN WITNESS WHEREOF, the City of �'air(ax, lowa and Soil Concepts, Inc. have signed this Supplemental
Agreement in duplicate. One counterpark each has been delivered to each party.
