RESOLUTION APPROVING THE SITE PLAN OF IMPROVEMENTS
FOR THE ROYALE POOL REDEVELOPMENT AT 54 E. CEMETERY
ROAD IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA
WHEREAS, the site plan of improvements for the proposed Royale Pool Redevelopment
at 54 E. Cemetery Road have been submitted to the City of Fairfax by Matt Shock, P.E. with
STS Solutions, LLC, on behalf of Ralston Construction and the property owners, Cory and Callie
Berg; and
WHEREAS, Hall and Hall Engineers, Inc. has reviewed said site plan of improvements,
which currently do not fully address storm water conveyance on the proposed site, and it does
not address storm water management for the proposed site; and
WHEREAS, as part of these proposed site improvements there is a request for a design
exception from the City's buffering and screening requirements for commercial development
adjacent to residential properties due to the existing evergreen trees located along the shared
property line on the adjacent residential property immediately west of this site; and
WHEREAS, City Staff and Hall and Hall Engineers, Inc. recommends that the City
Council approve the proposed site plan of improvements for the proposed Royale Pool
Redevelopment at 54 E. Cemetery Road with the following conditions:
PRIOR TO THE ISSUANCE OF ANY CONSTRUCTION OR BUILDING PERMIT FOR
THIS SITE, THE OWNER SHALL:
The Owner shall submit a signed Sanitary Sewer Connection Fee Agreement and the
required sanitary sewer connection fee to the City of Fairfax.
2. The Owner shall submit a signed Water Main Connection Fee Agreement and the
required water main connection fee to the City of Fairfax.
3. Complete the storm water drainage and storm water management design for the proposed
site improvements per the email submitted by Jon Larson on July 28, 2022 and Shane
Wicks on August 2, 2022, and update the site plan of improvements to address this
design.
4. Issue an acceptable site lighting plan for the proposed site plan of improvements.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa,
that the proposed site plan of improvements for the proposed Royale Pool Redevelopment at 54
E. Cemetery Road are hereby acknowledged and approved on the part of the City of Fairfax,
Linn County, Iowa with the following conditions:
PRIOR TO THE ISSUANCE OF ANY CONSTRUCTION OR BUILDING PERMIT FOR
THIS SITE, THE OWNER SHALL:
1. The Owner shall submit a signed Sanitary Sewer Connection Fee Agreement and the
required sanitary sewer connection fee to the City of Fairfax.
2. The Owner shall submit a signed Water Main Connection Fee Agreement and the
required water main connection fee to the City of Fairfax.
3. Complete the storm water drainage and storm water management design for the proposed
site improvements per the email submitted by Jon Larson on July 28, 2022 and Shane
Wicks on August 2, 2022, and update the site plan of improvements to address this
design.
4. Issue an acceptable site lighting plan for the proposed site plan of improvements.
BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the Mayor
and the City Clerk/Treasurer are hereby authorized and directed to execute said Resolution.

Re: Site Pian of Improvements for the Rayale Pool Redevelopment at 54 E. Cemetery Road in
the City of Fairfax, Linn County, lowa.
Mayor Frieden and Members of fihe �airfax City Council,
Matt Shock, P.E. with STS Solutions, LLC has submitted the site plan of improvements for the
proposed Royale Pool Redevelopment at 54 E. Cemetery Road in the City of Fairfax, Linn
County, lowa. City Staff and I have reviewed the site plan af improvements for these site
improvements. The site plan of impravements currently does not fully address storm water
conveyance on the proposed site, and does not address storm water management for the
proposed site improvements. The proposed improvements to this site also require connection
to the City's public water main facilities and public sanitary sewer facilities, which have
connection fees previously established with the City's 2013 Sanitary 5ewer and Water Main
Extension Project. In addition to these items, please notice that they are requesting a design
exception form the City's Buffering and screening requirements for commercial development
adjacent to residential property due to the existing evergreen trees located along the shared
property line an the adjacent residential property immediately west of this site.
