RESOLUTION ESTABLISHING SANITARY SEWER
CONNECTION FEES RELATIVE TO THE 2021 SANITARY SEWER
AND WATER MAIN EXTENSION PROJECT
WHEREAS, the City of Fairfax has constructed a sanitary sewer project known
as the 2021 Sanitary Sewer and Water Main Extension Project; and
WHEREAS, said sanitary sewer project provides potential sanitary sewer service
to a number of properties (developed and undeveloped) lying south of Linn Street (with
the vast majority of this area lying south of the CRANDIC Railroad tracks, east of U.S.
Highway 151, and north of Wright Brothers Blvd.); and
WHEREAS, said potential sanitary sewer service area shall be known as the
South Growth Area Drainage Basin, which covers a total area of approximately 2,655
acres and is currently located partly within the City of Fairfax, and partly in Linn County;
and
WHEREAS, the City of Fairfax has determined that portions of the costs of said
sanitary sewer project shall be reimbursed to the City in the form of connection fees in
accordance with Chapter 96.02 CONNECTION FEE of the City's Code of Ordinances;
and
WHEREAS, the City Engineer has calculated the cost of the Sanitary Sewer
Extension Project and has established the fees for connecting properties located within
this drainage basin to the City's sanitary sewer facilities that are part of the 2021 Sanitary
Sewer and Water Main Extension Project, and / or an extension of this sanitary sewer
proj ect.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, the following:
1. Sanitary Sewer Connection Fees for the 2021 Sanitary Sewer and Water Main
Extension Project located within the South Growth Area Drainage Basin shall
be as follows:
a. The sanitary sewer connection fee for Bushman First Addition to the
City of Fairfax, Linn County, Iowa shall be $1,787.35.
b. The South Growth Area Drainage Basin has a total area of
approximately 2,655 acres. Sanitary Sewer (SS) Line A conveys the
wastewater from the entire 2,655 acres from the South Growth Area
Drainage Basin, also identified as basin A. SS Line B conveys the
wastewater from sub-basin B, which is located west of Lefebure Road
and is approximately 1,212 acres in size. SS Line C conveys the
wastewater from sub-basin D and sub-basin E. Sub-basin D is
generally located along both sides of Lefebure Road and is
approximately 259 acres in size. Sub-basin E is located primarily east
of Lefebure Road and is approximately 1,163 acres in size.
c. 75% of the drainage basin / drainage sub-basin areas shall be used for
establishing the sanitary sewer connection fees.
d. The sanitary sewer connection fees shall be as follows:
i. SS Line A(drainage basin A): $397.56 per acre.
ii. SS Line B(drainage sub-basin B): $0.70 per Acre.
iii. SS Line C(drainage sub-basins D& E): $95.34 per acre.
iv. SS Line D(drainage sub-basin D): $1,012.33 per acre.
v. SS Line E(drainage sub-basin E): $29.88 per acre.
e. Properties which drain to multiple sanitary sewer (SS) Lines shall pay
the per acre connection fee for each SS Line that it drains to. For
example, a property that drains to SS Lines A, C, and D shall have a
connection fee of $1,505.23 per acre ($397.56/AC +$95.34/AC +
$1,012.33/AC).
£ The Connection Fees established above shall increase at an annual
interest rate of 1.7041029% per year beginning on January l, 2023,
and shall continue to increase at this interest rate each year through
2035. After these connection fees have been adjusted for interest in
2035, no further adjustments shall be made to these connection fees for
interest.
2. This sanitary sewer project has been constructed to convey wastewater from
the South Growth Area Drainage Basin based upon its size (approximately
2,655 acres), and the City's Land Use Map for this area at the time it was
designed and constructed in 2021. If a property develops at a more intensive
use than planned for with the 2021 Sanitary Sewer and Water Main Extension
Project, or if a property outside of the approximately 2,655-acre South Growth
Drainage Basin connects to of the City's Sanitary Sewer System, than the City
maintains the right to collect an increased Sanitary Sewer Connection Fee at
the City's discretion.
3. The applicant shall be responsible for all costs related to the installation of the
sanitary sewer service and / or main to the property.
4. The Sanitary Sewer Connection Fees shall be paid to the City Clerk by the
applicant prior to the approval by the City of the final plat, or if so decided by
the City Council, with the issuance of a building permit of a platted lot, or the
sale of a platted lot. If the proposed sanitary sewer connection is not part of a
platted subdivision for which these sanitary sewer connection fees have been
paid, then the connection fees shall be paid prior to the issuance of a building
permit or prior to the applicant's connection to the City's sanitary sewer main.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.
