HomeMy WebLinkAboutRESOLUTION NO. 2020-19 RESOLUTION NO. 2020-19 RESOLUTION APPROVING THE PLAN OF IMPROVEMENTS AND DRAINAGE REPORT FOR THE PROPOSED IMPROVEMENTS FOR HEARTLAND HEIGHTS BASIN AREAS TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA WHEREAS, the plan of improvements and drainage report for the Proposed Improvements for the Heartland Heights Basin Areas have been submitted to the City of Fairfax by Emily Volesky with Shive Hattery Architecture and Engineering, on behalf of Iowa Lot Development and Schrader Excavating and Grading Co.; and WHEREAS, This Wet Pond and Stream Embankment Grading is permitted under the U.S. Army Corps of Engineers Nationwide Permit Numbers 13 and 29, as well as Iowa DNR Flood Plain Development Permit No. FP2019-174.; and WHEREAS, Hall and Hall Engineers, Inc. has reviewed said plan of improvements and drainage report and they appear to be in general conformance with the City's design standards. Except for the grading and the lack of water quality basin(s) along the west side of this pond, these plans and drainage report also appear to be in general conformance with the approved preliminary plats for the Heartland Heights development.; and WHEREAS, Hall and Hall Engineers, Inc. has recommended approval of the Proposed Improvements for the Heartland Heights Basin Areas plan of improvements and drainage report with the following conditions: 1. The Owner/Contractor shall provide the City with a 4 Year Maintenance Bond for the public improvements (Pond & Pond Outlet Structure, Water Quality Basins and Outlet Structures, Sanitary Sewer, Trail, Trail Bridge, Sidewalk and Site Ground Cover Outside of the City's Participation Area). 2. Prior to the City accepting the sanitary sewer trunk main the Owner/Contractor shall provide the City with a video of the sanitary sewer trunk main once the sewer has been successfully installed and tested. 3. Prior to the City Accepting the Wet Pond and Associated Water Quality Basins, the Owner/Developer shall provide the City Certification by a licensed Engineer in the State of Iowa that the Wet Pond (Including the Outlet Structure, Overflow Spillway, and Normal Water Surface Area and Elevation) and the Water Quality Forebays have been constructed per the approved Plans. 4. Prior to the City Accepting the Wet Pond and Associated Water Quality Basins, trail, bridge, etc., the Owner/ Developer shall have a plat of survey or final plat completed and formally have this property dedicated to the City. If this property is dedicated to the City prior to all of the public improvements being completed on this property, such as the west water quality basin(s),the sanitary sewer trunk main extension, the trail or the trail bridge, then the Owner/Developer shall be fully responsible for constructing these improvements on the City's property. 5. The Trail located West of the Trail Bridge shall Not be constructed until: a. The sanitary sewer trunk main alignment is coordinated and finalized to a point north of Beverly Road and east of the creek, including City participation levels with this sewer. If this sewer alignment is located on the pond property, then the trail shall not be constructed until after this sewer has been installed throughout this property. b. The west water quality basin(s) are designed and constructed with the proper outlet structure(s) and pipe(s). If the trail is constructed prior to this basin(s) being designed and installed, then the Owner/Developer shall be fully responsible for all repairs and replacement of the trail and trail subgrade, including any temporary trail routing that may be necessary. 6. The City shall Not be responsible for any participation in the temporary of final establishment of ground cover on this property located west of the pond and north of the east-west creek since the final design and improvements in this area will not be completed with these improvements. 7. Prior to the installation of the sanitary Sewer, the Owner/ Contractor shall provide the City a copy of the Iowa DNR Sanitary Sewer Construction Permit. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, that the Proposed Improvements for the Heartland Heights Basin Areas Plan of Improvements and Drainage Report for Iowa Lot Development and Schrader Excavating and Grading Co., with the following conditions: 1.
