RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC
FEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND
ORAL COMMENTS ON A REZONING REQUEST
WHEREAS, the State of Iowa's City Development Board approved a 100%
voluntary annexation for the City of Fairfax during their July 8, 2020, meeting; and
WHEREAS, the new property owner, Logistics Park Cedar Rapids, LLC, is
requesting a zoning change from AG: Agricultural to M1: Light Industrial District for the
following described property:
THAT PART OF THE SOUTH HALF(S1/2)OF THE NORTHWEST QUARTER
(NW 1/4) OF SECTION FIFTEEN (15), LYING SOUTH OF THE RIGHT-OF-WAY OF
THE C.M. ST. P & P RAILWAY COMPANY, AND THE NORTH HALF (N1/2) OF
THE SOUTHWEST QUARTER (SW1/4) OF SECTION FIFTEEN (15), ALL IN
TOWNSHIP EIGHT-TWO (82)NORTH,RANGE EIGHT(8) WEST OF THE FIFTH(5)
P.M., EXCEPTING ALL LEGAL HIGHWAYS.
and
WHEREAS, Iowa Code requires a public hearing concerning rezoning of this
property; and
WHEREAS, interested residents or taxpayers having comments for or against the
proposed rezoning may appear and be heard at the public hearing at the city council
meeting on August 18, 2020, at 6:00 PM at Fairfax City Hall at 300 80th Street Court,
Fairfax, Iowa; and
WHEREAS, due to the COVID-19 crisis, the City of Fairfax may be holding this
city council meeting electronically via a conference call. If so, and if you would like to
participate, at least 10 minutes before the meeting start time, you must call 425-436-6370
and enter this access code: 759797. Only staff are allowed in city hall.
If you are having difficulty connecting to the meeting you can:
1. Send a text message to the conference dial-in number. Text "Help" to receive a text
message with a temporary backup number. Tap the number in your text to dial it.
2. Or you can text "Call Me" to receive a call that connects you with the dial-in.
3. Once connected, enter your access code as normal. If the City decides to allow some
people in person, there will be a limit of the number of people, social distancing required,
and other requirements as the City may deem to help ensure the safety of staff and the
public.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, that this confirms that the city council order the publication of a notice of
public hearing pertaining to this rezoning request on behalf of the City of Fairfax.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed
to execute said resolution.
