RESOLUTION NO. 2020-73 APPROVE 2020 AMENDMENT TO FAIRFAX URBAN RENEWAL AREA PLAN AND TIF ORDINANCE AMENDMENT 419915-29 Fairfax, Iowa September 8, 2020 The City Council of the City of Fairfax, Iowa, met on September 8, 2020, at 6:00 p.m., at the City Hall, for the purpose of conducting a public hearing on a proposed urban renewal plan amendment. The Mayor presided and the roll being called the following members of the Council were present and absent: Present: Travis Otto Mike Daly, Kate Pacha, Nick Volk, and Marianne Wainwright Absent: None It was reported that notice of the intention of the Council to conduct a public hearing on the 2020 Amendment to the Urban Renewal Plan for the Fairfax Urban Renewal Area had been published according to law and as directed by the Council and that this is the time and place at which the Council shall receive oral or written objections from any resident or property owner of the City. All written objections, statements, and evidence heretofore filed were reported to the Council. The following named persons presented oral objections, statements, or evidence; filed written objections or statements; or presented other exhibits: Jo Ann Beer had contacted city hall with questions about TIF and our GO debt limit. During the hearing she asked about the timing of TIF revenues and how the City will prioritize projects. There being no further objections, comments, or evidence offered, the Mayor announced the hearing closed. Council Member Otto moved the adoption of a resolution entitled "A Resolution to Approve 2020 Urban Renewal Plan Amendment for the Fairfax Urban Renewal Area", seconded by Council Member Pacha. After due consideration, the Mayor put the question on the motion and the roll being called, the following named Council Members voted: Ayes: Otto Daly Pacha Volk, and Wainwright Nays: None. Whereupon, the Mayor declared the resolution duly adopted and signed approval thereto. RESOLUTION NO. 2020-73 A RESOLUTION TO APPROVE 2020 URBAN RENEWAL PLAN AMENDMENT FOR THE FAIRFAX URBAN RENEWAL AREA WHEREAS, the City Council of the City of Fairfax, Iowa (the "City") has created the Fairfax Urban Renewal Area(the"Urban Renewal Area")and has approved an urban renewal plan for the Urban Renewal Area; and WHEREAS, Chapter 403 of the Code of Iowa requires that, before a city adds property to an urban renewal area or approves any new urban renewal project, a city must amend the existing urban renewal plan to describe the new property and to include that new project; and WHEREAS, an amendment to the urban renewal plan for the Urban Renewal Area has been prepared which proposes to add to the Urban Renewal Area certain property that was recently annexed into the City and which describes the use of incremental property tax revenues for certain infrastructure improvements in the Urban Renewal Area; and WHEREAS,notice of a public hearing by the City Council on the proposed urban renewal plan amendment was heretofore given in compliance with the provisions of Chapter 403 of the Code of Iowa, and the Council has conducted the hearing; and WHEREAS, copies of the urban renewal plan amendment, notice of public hearing and notice of a consultation meeting with respect to the urban renewal plan amendment were sent to Linn County and the College Community School District in accordance with state law; NOW, THEREFORE, It Is Resolved by the City Council of the City of Fairfax, Iowa, as follows: Section 1. An economic development area as defined in Chapter 403 of the Code of Iowa is found to exist with respect to the property described in the 2020 Amendment to the Urban Renewal Plan. Section 2. The property identified in Section 1 hereof is hereby declared to be an urban renewal area, in conformance with the requirements of Chapter 403 of the Code of Iowa, and the development of this property is necessary in the interest of the public welfare of the residents of the City. Section 3. It is hereby determined by this City Council as follows: A. The 2020 Amendment to the Urban Renewal Plan for the Fairfax Urban Renewal Area conforms to the general plan of the City. B. The proposed urban renewal projects described in the 2020 Amendment to the Urban Renewal Plan for the Fairfax Urban Renewal Area are necessary and appropriate to facilitate the proper growth and development of the City in accordance with sound planning standards and local community objectives. Section 4. The 2020 Amendment to the Urban Renewal Plan for the Fairfax Urban Renewal Area, attached hereto and made a part hereof, is hereby in all respects approved, and the proposed urban renewal projects included in such amendment are hereby in all respects approved. Section 5. All resolutions or parts thereof in conflict herewith are hereby repealed, to the extent of such conflict. Passed and approved September 8, 2020. Burnell G. The property to be added to the Urban Renewal Area was recently annexed into the City and is described as follows: THAT PART OF THE SOUTH HALF (S1/2) OF THE NORTHWEST QUARTER (NW1/4) OF SECTION FIFTEEN (15), LYING SOUTH OF THE RIGHT-OF-WAY OF THE C.M. ST. P. & P. RAILWAY COMPANY, AND THE NORTH HALF (N1/2) OF THE SOUTHWEST QUARTER (SW1/4) OF SECTION (15), ALL IN TOWNSHIP EIGHT-TWO (82) NORTH, RANGE EIGHT (8) WEST OF THE FIFTH (5) P.M. The infrastructure projects for which incremental property tax revenues will be used include the following: - Sanitary sewer extension to serve Alliant Energy Transportation(AET)site and facility - Water Main extension to serve AET site and facility, including water main loop along Williams Boulevard and Southview Road - Sanitary sewer and water main extensions to serve Dollar General site - Bridge replacement and Eagleview Drive design services - Right-of-way and easement acquisitions for utility extensions, bridge replacement and Eagleview Drive realignment - Iowa Department of Transportation Highway 151 Reconstruction(City portion) - Church Street HMA and Drainage Improvement from Highway 151 through Vanderbilt Street intersection - Prairie Avenue PCC Improvement (3 blocks) - Vanderbilt Street Maintenance/repairs through downtown - City park improvements The following information is provided in accordance with the requirements of Section 403.17 of the Code of Iowa: Outstanding general obligation debt of the City $8,326,000 Constitutional debt limit of the City: $13,715,331 Proposed debt payable from incremental property tax revenues, subject to annual appropriation by City Council: $7,780000
