RESOLD 1ION 2000-02-0
WHEREAS, on December 1, 1995 the City of Fairfax,Iowa entered into a contract with
Dave Schmitt Construction Co. Inc. for the construction of 1998 'Sewer and Water Extensions in
Fairfax,Iowa and
WHEREAS, the construction of said project is now substantially complete and
WHEREAS,repair work on East Cemetery Road remains but cannot be completed due to
weather conditions.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Fairfax,
Iowa,that the 1995 Sewer and Water Extensions project is hereby accepted and a payment of
$15,441.34 of the retainage is hereby authorized and
BE IT FURTHER RESOLVED that the amount of$4,000.00 shall be withheld from
payment on this project until the repairs to East Cemetery Road have been completed to the
satisfaction of the City.
