WHEREAS, an agreement outlining means for the provision of sanitary sewer services by the City of Cedar Rapids for a specific area within the Fairfax corporate limits and for establishment of a future common corporate limit line has been drafted by the cities of Cedar Rapids and Fairfax, and WHEREAS, a public hearing has been held to consider comments regarding said proposed agreement, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CEDAR RAPIDS, IOWA, that the Mayor and Clerk are hereby-authorized and directed to execute said intergovernmental agreement. MAYOR A'T'TEST: CITY CLERK 28E Agreement Between the City of Fairfax and the City of Cedar Rapids Regarding the Provision of Sanitary Sewer to a Specific Area and the Annexation of Properties March 2001 Intent This agreement establishes a policy instrument regarding the provision of sanitary sewer by Cedar Rapids to Fairfax, and the annexation of unincorporated land by Fairfax and Cedar Rapids. Duration . This agreement will remain in effect from the date of execution by both parties until the year 2025, unless shorter or longer duration is mutually agreed upon by the City Councils of both jurisdictions. Provisions Sanitary Sewer Service. The City of Cedar Rapids shall allow the City of Fairfax to connect to the single sewer extension within the specific area described as follows and mapped on the attached exhibit,subject to mutual agreement of the parties. All that part of the southeast quarter of section3,township 82 north, range 8 west of the 5th principal meridian, Linn County,Iowa, lying southeasterly of the southeasterly right of way of U.S. Highway N. 151 and lying south of the south right of way of Beverly Road :w and all of the northeast quarter of the northeast quarter of section 10,township 82 north, range 8 west of the 5"' principal meridian,Linn County, Iowa. Sewer facility improvements shall meet Cedar Rapids Metro Area Design Standards Manual criteria, and all plans and specifications for such improvements shall be submitted to the City of Cedar Rapids for review and coordination of needs prior to contract letting. Annexation. The following paragraphs are subject to the provisions of State Code section 368.4. The cities of Cedar Rapids and Fairfax Hereby agree that the following legal description shall define the limitations of future annexations between the two jurisdictions, and that neither will annex land on the side of the line opposite their current city(numbers in parentheses are map location references -map attached): A line beginning at the intersection of the centerline of Hwy 151 and the centerline of Wright Brothers Blvd. in Linn County, Iowa;thence easterly along the centerline of Wright Brothers Blvd. to (1)the SW corner of Section 21-82-8; and thence easterly to (2)the SE corner of the SW 1/4 SW '/of Section 23-82- 8;thence northerly to (3)the SE corner of the NW %a NW '/4 of Section 1.4-82-8;thence easterly to(4)the SE corner of the NE '/NW 1/4 of Section 14-82-8; thence northerly to(5)the SE corner of the SE '/NW '/4 of Section 11-82-8;thence westerly to (6)the SW corner of the SE'/4 NW 't4 of Section 11-82-8- thence northerly to (7)the NW corner of the 'SE'/NW %of Section 11-82-8;thence westerly to (8)the SW corner of the NW '/NW '/4 of Section 11-82-8; thence northerly to(9)the NW corner of the SW '/4 SW "/ of Section 2-82-2,thence westerly to(10)the centerline of U.S. Hwy.151;thence westerly along Beverly Road to(11)the SE corner of the NW '/SW 1/4 in Section 3-82-8. From this point the agreement line splits into north and south elements described in the following paragraphs. The city of Cedar Rapids agrees not to annex south of the southern element and the city of Fairfax agrees not to annex north of the north element. Lands between the two lines may be annexed by either city, North Element; Starting at (11)above,thence northerly to (IN) the NE corner of the NW '/4 SW '/of Section 3-82-8;thence westerly to (2N)the SW corner of the SW '/4 NW F/4 of Section 3-82-8;thence northerly to (3N)the NW corner of the SW'/4 NW '/4 of Section 3-82-8; thence westerly to(4N)the intersection of the center lines of Morgan Bridge Road and Morgan Valley Road;thence continuing westerly along the centerline of Morgan Valley Road to(5N)the intersection of Morgan Valley Road and Linn Benton Road. which is the NW corner of the SW f/4 NW '/4 of Section 6-82-8 on the Linn-Benton County line. South Element: Beginning at(11)above,thence westerly to (1 S)the SW corner of the NE 1/4 SW 1/4 of Section 5-82-8;thence northerly to (2S)the NW corner of the south %2 of the NW '/4 SW '/4 of Section 5-82-8; thence westerly to(3S)the midpoint of the west line of the NE %4 SW Y4 Section 6-82-8;thence southerly to(4S)the SE corner of the NE 1/4 SW I/4 of Section 6-82-8; thence westerly to (5S), a point on the west line of Section 6-82-8, the Linn-Benton County Line, Subdivision Plat Review. The City of Fairfax hereby agrees to transfer to the City of Cedar Rapids its extraterritorial subdivision plat approval authority(to within two miles of its corporate limits) in annexation areas listed above which. are to annex to Cedar Rapids; however, it is also agreed that the City ofCedar Rapids will send a copy of such plats to the City of Fairfax for comments prior to final approval of such plats. The City of Cedar Rapids hereby agrees to transfer to the City of Fairfax its extraterritorial subdivision plat approval authority(to within two miles of its corporate limits) it annexation areas listed above which are to annex to Fairfax; however, it is also agreed that the City of Fairfax will send a copy of such plats to the City of Cedar Rapids for comments prior to final approval of such p Cats. In the area between the north and south elements of the agreement line,, extraterritorial subdivision plat approval authority shall be shared between the two cities. Public Improverments Standards. The City of Fairfax hereby agrees to adopt, as soon as possible, development.standards for water, sanitary sewer,storm sewer,drainage facilities,and streets/sidewalks that are consistent with the Cedar Rapids Metro Area Design Standards Manual. Further,the City of Fairfax agrees that engineering construction plans for those sanitary sewer projects connecting to the City of Cedar Rapids sanitary sewer system and constructed after the execution date of this agreement shall be submitted for review to City of Cedar Rapids City Engineer prior to contract letting. Amendment.
