RESOLUTION APPROVING SIDEWALK DEFERMENT
North Border Lot 10,Fairfax Heights First Addition
WHEREAS,a request for deferment of sidewalk along the north end of Lot 10,Fairfax Heights First
Addition to the City of Fairfax,Iowa in Linn County,Iowa,has been received from Patrick Slater, and
WHEREAS,it has been determined that sidewalks are not feasible at this time.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX,
IOWA,to approve a deferment of the required sidewalk along the north end of Lot 10,Fairfax Heights
First Addition to the City of Fairfax,Iowa in Linn County,Iowa. Said deferment shall run with the land
and shall be binding upon,all present and future owners of the subject property with the clear understanding
that any present or future owner of said property shall be responsible for.all installation costs of sidewalk
along the north end of Lot 10,Fairfax Heights First Addition to the City of Fairfax,Iowa in Linn County,
Iowa,at such time that the City of Fairfax,Iowa,determines installation of sidewalk is proper. The City
Council further directs the City Clerk to file this resolution with the Linn.County Recorder's Office.
Passed and approved this 9th day of July 2002.

Please consider this correspondence as a formal request to defer construction of a sidewalk on the north most section of Lot
10,Fairfax Heights First Addition to the City of Fairfax, Iowa. Presently,this sidewalk would provide no benefit as it would
"dead end"into Mr. Harold McCormick's field. Thank you for your consideration.
