RESOLUTION APPROVING SIDEWALK DEFERMENT
South Border Lot 21,Prairie View Estates-Part I
WHEREAS,a request for deferment of sidewalk along the south end of Lot 21,Prairie View Estates-Part
I to Fairfax,Iowa in Linn County,Iowa,has been received from Doyle Construction,and
WHEREAS,it has been determined that sidewalks are not feasible at this time.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX,
IOWA,to approve a deferment of the required sidewalk along the south end of Lot 21,Prairie View Estates
-Part I to Fairfax,Iowa in Linn County,Iowa. Said deferment shall ruse with the land and shall be binding
upon all present and future owners of the subject property with the clear understanding that any present or
future owner of said property shall be responsible for all installation costs of sidewalk along the south end
of Lot 21,Prairie View Estates-]Fart I to Fairfax,Iowa in Linn County,Iowa,at such time that the City of
Fairfax,Iowa,determines installation of sidewalk is proper. The City Council further directs the City Clerk
to file this resolution with the Linn County Recorder's Office,
Passed and approved this 9th day of July 2002.

I AM ASKING FOR YOUR PERMISSION TO DEFER THE. SIDEWALK REQUIREMENT
ON THE SOUTH BOUNDARY OF 401 PRAIRIE VIEW CIRCLE(LEGAL; LOT 21 PRAIRIE
VIEW ESTATES, PART 1, FAIRFAX, LINN COUNTY). THE REASON FOR THIS
REQUEST IS THAT THE STREET DEAD-ENDS TO AN EXISTING CORN FIELD WITH
NO PLANS FOR DEVELOPMENT AT THIS TIME. THANK YOU FOR YOUR
CONSIDERATION.
