A RESOLUTION APPROVING SITE PLAT OF SURVEY NO. 1613, PARCEL A
& PARCEL B — PARTS OF LOTS 12, 13, AND 29 PRAIRIE CREEK ESTATES
THIRD ADDITION
WHEREAS, Synergy Development Group, L.L.C. and Brain Engineering, Inc.
have submitted a Site Plat of Survey No. 1613, Parcel A & Parcel B —Parts of Lots 12,
13, and 29 Prairie Creek Estates Third Addition; and
WHEREAS, Hall and Hall Engineers, Inc. have reviewed said Plat of Survey and
submitted a recommendation letter; and
WHEREAS, the Fairfax Planning and Zoning Commission has reviewed said
Plat of Survey and passed Recommendation No. 2010-06, which recommends that the
Fairfax City Council approve Plat of Survey No. 1613 with the stipulation that prior to
issuing an occupancy permit for lot 29, the house builder submit to the City of Fairfax a
site plan of the house situated on the revised lot as shown on Plat of Survey No. 1613,
including all house overhangs, to ensure that no part of the house encroaches within the
utility easement.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Fairfax, Iowa, approves Site Plat of Survey No. 1613, Parcel A & Parcel B — Parts of
Lots 12, 13, and 29 Prairie Creek Estates Third Addition with the stipulation that prior to
issuing an occupancy permit for lot 29, the house builder submit to the City of Fairfax a
site plan of the house situated on the revised lot as shown on Plat of Survey No. 1613,
including all house overhangs, to ensure that no part of the house encroaches within the
utility easement as recommended by the Fairfax Planning and Zoning Commission.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk are hereby authorized and directed to
execute said Resolution.
