RESOLUTION APPROVING THE ISSUANCE OF AN "AT YOUR OWN
RISK" BUILDING PERMIT FOR LOT 8 OF PRAIRIE CREEK ESTATES
FIFTH ADDITION TO THE CITY OF FAIRFA ,, LINN COUNTY, IOWA
WHEREAS, Prairie Creek Partners, L.L.C. has requested a building permit for lot 8 of
Prairie Creek Estates Fifth Addition to the City of Fairfax,Linn County, Iowa; and
WHEREAS, the public improvements for Prairie Creek Estates Fifth Addition have not
yet been completed and accepted by the City of Fairfax; and
WHEREAS, the final plat for Prairie Creek Estates Fifth Addition to the City of Fairfax,
Linn County,Iowa has not yet been recorded by City Council; and
WHEREAS, the following conditions shall be met by Prairie Creek Partners, L.L.C.
prior to the issuance of an "At Your Own Risk" Building Permit, and throughout construction of
a home(s) on lot 8 of Prairie Creek Estates Fifth Addition:
• access for Emergency vehicles be provided and maintained at all times by the
contractor/property owner from the end of the existing public street to this lot; and
• that all other applicable requirements of a standard building permit for similar
residential homes are met; and
WHEREAS, no Occupancy Permits shall be granted for any construction until the final
plat has been approved and recorded and the public improvements have been completed and
accepted by the City Council.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa to authorize the issuance of an"At Your Own Risk" Building Permit for the construction of
a homes) on lot 8 of Prairie Creek Estates Fifth Addition, contingent on meeting the conditions
as outlined above. It is the understanding of all parties involved that any construction done
before the final plat for Prairie Creek Estates Fifth Addition is recorded and the public
improvements for said development are accepted by the City Council is done entirely at the
contractor's and/or property owner's risk.
BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the Mayor
and the City Clerk are hereby authorized and directed to execute said Resolution.
