A RESOLUTION TO ISSUE FINAL PAYMENT TO YORDI EXCAVATING, INC
FOR THE 20011. WATER MAIN REPLACEMENT PROJECT
WHEREAS, On February 11, 2003 Resolution No. 03-02-11-3 was adopted.
accepting the 2001 Water Main Replacement Project from Yordi Excavating, Inc,; and,
WHEREAS, Said Resolution directed the City Clerk to retain the balance due of
$5,642.93 until a claim filed against the project had been resolved, and,
WHEREAS, The City of Fairfax, Iowa, resolved the claim at a cost of$2,410.00;
and,
NOW, THEREFORE BE IT RESOLVED, By the City Council of the City of
Fairfax, Iowa, That the City Clerk is hereby directed to issue payment in the amount of
$3,232,93 as final payment for the 2001 Water Main Replacement Project to Yordi
Excavating, Inc,

RE: Retainage from 2001 Water Main Replacement Project
Honorable Mayor and City Council Members,
I am writing this letter in reference to the retainage monies withheld from the 2001 Water
Main Replacement Project constructed by Yordi Excavating, Inc. in Fairfax. The project
was accepted on February 1 2003 less retainage of $5,642.93 due to the possibility of a
claim by a business property owner along the project route. The property owner had until
the bond expiration date to file a claim and did not do so. We are requesting the retainage
be released at this time since the bond has expired as of February 12th, 2005. Thank you
for your time concerning this matter and would appreciate a timely response.
