A RESOLUTION AUTHORIZING ASSESSMENT OF A LIEN AGAINST THE
PROPERTY FOR NONPAYMENT OF BILLED CHARGES FOR SNOW REMOVAL
Be it enacted by the City Council of the City of Fairfax,Iowa:
BE IT RESOLVED,that delinquent maintenance charges are due from Todd Philipp for snow
removal services provided at 331 Vanderbilt St.,Fairfax,Iowa,in the amount of$190.00 and that the City
Clerk is directed to certify these delinquent charges to the Linn County Treasurer for purposes of placing
a lien against the properties pursuant to Iowa Code 364.12.
Todd Philipp was in violation of Chapter 136,Section 136.013,REMOVAL OF SNOW,ICE
AND ACCUMULATIONS, Code of Ordinance,City of Fairfax which states:
It is the responsibility of the abutting property owners to remove snow, ice and accumulations
promptly from sidewalk, If a property owner does not remove snow, ice or accumulations within
a reasonable time,the city may do so and assess the costs against the property owner for
collection in the same manner as a property tax.
THEREFORE,BE IT RESOLVED,By the City Council for the City of Fairfax,Iowa that the
Mayor and City Clerk are hereby authorized and directed to execute said Resolution.
