A RESOLUTION APPROVING 28E AGREEMENT
BETWEEN THE CITY OF CEDAR RAPIDS,IOWA, CITY OF
FAIRFA ,IOWA AND LINN COUNTY,IOWA
BE IT RESOLVED, That the Cities of Cedar Rapids and Fairfax, and Linn
County enter into an agreement pursuant to Chapter 28E of the Code of the State of Iowa,
providing for certain understandings relating to the construction, maintenance and.
operation of the traffic signals and street lighting at the intersection of U.S. Highway 151
(Williams Boulevard) &Beverly Road/Stoney Point Road SW.
BE IT RESOLVED, By the Fairfax City Council of the City of Fairfax, Iowa,
that the Mayor and City Clerk are hereby authorized to execute said 28E Agreement with
the City of Cedar Rapids, Iowa, and Linn County, Iowa.
NOW, THEREFORE, BE IT FURTHER RESOLVED, By the Fairfax City
Council of the City of Fairfax, Iowa, that the Mayor and City Clerk are hereby authorized
and directed to execute said Resolution.

Attached for your review and (Board approval is a 28E Agreement providing for
construction, operation and maintenance of the proposed traffic signals and street
lighting at the above intersection. Cedar Rapids will need Linn County and Fairfax
approval of this 28E Agreement jointly with approval of the Iowa D.O.T.
Preconstruction Agreement(s). Please advise if you have any questions with this
281E Agreement prior to approval by your Board.

WHEREAS, the Iowa Department of Transportation has programmed the H!MA
Pavement Widening with HMA Resurfacing Project on US Hwy 151 (Williams Boulevard) from
Fairfax northeasterly to the west junctions with US Hwy 30, STPN-151-3-30(120)- -2J-57 and
the installation of a traffic signal at the intersection of US Hwy 151 (Williams Boulevard) and
Beverly Road/Stoney Point Road, STPN-151-3(124)- -2J-57, and
WHEREAS, the Iowa D.O.T. is requiring financial participation and operation and
maintenance responsibilities fi om the Cities of Cedar Rapids and Fairfax and Linn County for
implementation of the above projects, and
WHEREAS, the Traffic Engineering Department recommends approval of a 26E
Agreement with Linn County and the City of Fairfax for operation and maintenance of traffic
signals at the intersection of US 151 (Williams Boulevard) and Beverly Road/Stoney Point Road-
SW, now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CEDAR RAPIDS, IOWA,
that the Mayor and City Clerk are hereby authorized to sign said 28E Agreement.
BE IT FURTHER RESOLVED that traffic signals be installed at the intersection of US
151 (Williams Boulevard) and Beverly Road/Stoney Point Road SW and the Traffic Engineering
Department is authorized to operate said traffic signals in a flashing mode during off-peak
hours.

CHAPTER 28E AGREEMENT
BETWEEN THE CITY OF CEDAR RAPIDS, IOWA,
CITY OF FAIRFAX, IOWA AN'D
LINN COUNTY, IOWA
WHEREAS, the Iowa D.O.T. is proposing to install traffic signals at the intersection
of U.S. Highway 151 (Williams Boulevard) & Beverly Road/Stoney Point Road SW as part
of the HMA Pavement Wideniiing with HMA Resurfacing Project on U.S. 151 (Williams
Boulevard) from Fairfax northeasterly to the west junctions with U.S. Highway 30, STPN
151-3-30(120) - - 2J – 57, anod
WHEREAS, portions of'said project occur within the Corporate Limits of Cedar
Rapids, Fairfax, and within Limn County as identified on Exhibit A.
BE IT RESOLVED, that the Cities of Cedar Rapids and Fairfax, and Linn County
enter into an agreement pursuant to Chapter 28E of the Code of the State of Iowa,
providing for certain understandings relating to the construction, maintenance and operation
of the traffic signals and street llli,ghting at the intersection of U.S. Highway 151 (Williams
Boulevard) & Beverly Road/Stoii'ey Point Road SW, and these understandings shall be as
follows:
A. This agreement shall apply to the construction„ maintenance, and operation
of traffic signals and street lighting at the intersection of U.S. Highway 151
(Williams Boulevard) & Beverly Road/Stoney Point Road SW. Said traffic
signals and street lighting shall be in effect for the time length mutually
agreed upon by the Cities of Cedar Rapids and' (Fairfax, Linn County, and the
Iowa D.O.T.
B. The construction cost for the new traffic signal installation is provided in a
separate Preconrstruction Agreement.
C. Four (4) new or reconstructed street lights will 'be provided at the intersection
with construction of the new traffic signals. Any street lighting construction
costs incurred by the City of Cedar Rapids will be shared by Linn County and
the City of Fairfax, Linn County will reimburse the City of Cedar Rapids for
50% of the street light costs and Fairfax will reimburse the City of Cedar
Rapids for 25% of the street light costs.

D. The City of Cedar Rapids shall be responsible for all maintenance associated
with said signals and street lighting, payment of all utility costs associated
with said signals and street lights, and replacement of said signals and street
lights should they be damaged or otherwise caused inoperable. Linn County
will reimburse the City of Cedar Rapids for 50,% of the utility costs and 50% of
the replacement and maintenance costs and Fairfax will reimburse the City of
Cedar Rapids for 25% of the utility costs and 25% of the replacement and
maintenance costs associated with operation maintenance and replacement
of the signals and street lighting.
The City of Cedar Rapids shall submit to Linn County and Fairfax periodic
invoicing of the utility, replacement, and maintenance costs upon which said/
reimbursement will be made. The City of Cedar Rapids shall provide a
summary of labor, equipment and material expenses as the basis for
reimbursement.
E. The Cities of Cedar Rapids and Fairfax, and Linn County shall share all
liabilities which may incur in connection with said signal and street light,
installation, operation and maintenance, 25% Cedar Rapids, 25% Fairfax,
and 50% Linn County,
F. Should the southeast and/or the northwest quadrants of this intersection be
annexed into either of the cities, with the limits of the annexation area(s) at
least 500 feet each way from the centerline of the intersection, this 28E
agreement shall l be modified such that the percentages of utility,
maintenance, replacement, and liability costs will be adjusted to reflect the
number of quadrants of the intersection within each jurisdiction divided by
four (4) quadrants.
This agreement shall be in full force and effect upon execution and shall remain in
effect until such time as it may, be further amended by agreement of all parties or the
conditions of Section F are met.
