RESOLUTION NO.
RESOLUTION TO RESCIND RESOLUTION NO. 007-41 ACCEPTING THE
IMPROVEMENTS IN PRAIRIE CREEK ESTATES FIRST AND SECOND
ADDITIONS TO FAIRFAX, IOWA,AND APPROVING THE MAINTENANCE
BOND SUBMITTED BY HORSFIELD CONSTRUCTION,INC.
WHEREAS, The City Council of the City of Fairfax, Iowa, at the meeting dated
July 10, 2007, passed and approved Resolution No. 2007-41 Accepting the Improvements
in Prairie Creek Estates First and Second Additions and approving the Maintenance Bond
submitted by Horsfield Construction, Inc.; and
WHEREAS, The City Council of the City of Fairfax, Iowa, previously passed
and approved Resolution No. 2006-105 Accepting the Improvements in Prairie Creek
Estates First, Second, and Third Additions and Approving the Maintenance Bond
submitted by Horsfield Construction, Inc,
BE IT RESOLVED, By the City Council of the City of Fairfax, Iowa, that
Resolution No. 2007-41 is a duplicate of Resolution No. 2006-105 and is therefore
rescinded in its entirety.
NOW, THEREFORE, BE IT FURTHER RESOLVED,By the City Council of
the City of Fairfax, Iowa, that the Mayor and City Cleric are hereby authorized and
directed to execute said Resolution.
