RESOLUTION NO. 2008-52:
RESOLUTION SETTING PUBLIC HEARING FOR VOLUNTARY ANNEXATION AND
ZONING CLASSIFICATION
WHEREAS, The Fairfax. City Council has received applications from Kenneth, Regis, and
Barbara Arp,requesting Voluntary Annexation of certain territory to the City of Fairfax, Iowa; and
WHEREAS, A zoning request has been proposed by Kenneth, Regis, and Barbara Arp for a
zoning classification of AG (Agricultural), all of which is located in that portion of the Northwest
Quarter of the Southwest Quarter (1NWI/4 SWI/4) in Section Ten (10), Township Eighty-Two North
(T82N), Range Eight West (R8W) of the Fifth Principal Meridian, Linn County, Iowa, described as
follows:
"Commencing at the West Quarter (W%) corner of said' Section 10; thence S01012'38"E
on the West line of said NWI/ SW% a distance of 258.84 feet to the South line of the
North 258.71 feet of said NWI/4 SWI/4 and the point of beginning; thence S89025116"E on
said South line a distance of 395.28 feet to the East line of the West 395.09 feet of said
NWI/ SW%,, thence N01112'3811W on said East line a distance of 258.84 feet to the
North line of said NWI/4 SWI/4; thence S89025'16"E on said North line a distance of
99.66 feet; thence S01120'19"E a distance of 389.34 feet.; thence S8913611511W a distance
of 495.62 feet to the west line of said NW'/4 SWI/4 thence N01012'38"W on said West
line a distance of 138.91 feet to the point of beginning. The north line of said NWI/4
SWI/4 is assumed to bear S89125'16"E. Described parcel contains 2.13 acres, including
0.08 acres of existing road right of way."
BE IT RESOLVED, That the Fairfax City Council does hereby set the date of Tuesday,
December 9, 2008, at 7:00 PM, or soon thereafter, for a Public ]rearing for the purpose of public
input on the Voluntary Annexation and Zoning Classification.
NOW, THEREFORE, BE IT RESOLVED, By the City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk are hereby authorized and directed to execute said Resolution.
