RESOLUTION APPROVING THE VOLUNTARY ANNEXATION AND ZONING
CLASSIFICATION OF PROPERTY LOCATED IN PART OF THE NW'/4 OF THE
SWl/4, SECTION 10,TOWNSHIP 82 NORTH,RANGE 8 WEST,LINN COUNTY,IOWA
(Kenneth,Regis, and Barbara Arp, Request)
WHEREAS, Kenneth, Regis, and Barbara Arp, owners of the property located in that
portion of the NW'/4 of the SWI/4, Section 10, Township 82 forth, Range 8 West of the Fifth
Principal Meridian, Linn County,Iowa, legally described as follows:
"Commencing at the West Quarter (WI/4) corner of said 'section 10; thence S01°12'38"E
on the West line of said NW'/4 SW'/4 a distance of 258,84 feet to the South line of the
North 258.71 feet of saidNWl/4 SW'/4 and the point of beginning; thence S89°25'16"E on
said South line a distance of 395.28 feet to the East line of the West 395,09 feet of said
NWI/a SWI/4; thence NO1°12'38"W on said East line a distance of 258.84 feet to the
North line of said NW°/4 SWI/4; thence S89°25'16"E on said North line a distance of
99.66 feet; thence SOI M'20'19"E a distance of 389.34 feet; thence S89°36'15"W a
distance of 495.62 feet to the west line of said NW'/4 SWI/4;thence NO 1'12'38"W on said
West line a distance of 118.91 feet to the point of beginning. The north line of said NWI/4
SW'/4 is assumed to bear '589°25'16"E. Described parcel contains 2.13 acres, including
0.08 acres of existing road right of way."
WHEREAS, Kenneth, Regis, and Barbara Arp did make voluntary application dated
August 4, 2008, for the annexation of said property to the City of Fairfax, Iowa; and
WHEREAS, It appears desirable and in the best interest of the City of Fairfax, that said
property referred to in said application be annexed to the City of Fairfax, Iowa, at this time; and
THEREFORE, BE IT RESOLVED, By the City Council of the City of Fairfax, Iowa,
that the property herein before described by and the same is hereby annexed to the City of
Fairfax, Linn County, Iowa, in the manner provided in Section 368.7, Code of Iowa 2007
Supplement, and such property shall hereinafter be and become part of the City of Fairfax, Linn
County, Iowa, entitled to all of the privileges and subject to all obligations as an integral part of
the said City; and
BE IT FURTHER RESOLVED, That said property will be annexed with the zoning
classification of AG (Agricudtural),subject to obtaining acknowledgement from the City
Development Board that said annexation is complete; and
BE IT FURTHER RESOLVED, That the City Clerk be authorized and directed to file a
copy of this resolution, map and legal description of the territory annexed with the City
Development Board as specified by the Code of Iowa; and
BE IT FURTHER RESOLVED, That the City Development Board be authorized and
directed to record a copy of the legal description, map, and resolution with the appropriate
agencies,the Linn County Recorder, and thereafter to be filed with the Linn County Auditor; and
NOW, THEREFORE, BE IT FURTHER RESOLVED, By the City Council of the
City of Fairfax, Iowa, that the Mayor and City Clerk are hereby authorized and directed to
execute said Resolution.
