RESOLUTION ACCEPTING THE PUBLIC IMPROVEMENTS TO PRAIRIE CREEK
ESTATES FIFTH ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY,IOWA
WHEREAS, Hall and Hall Engineers, Inc. has performed part-time field observations
during the installation of the public improvements, reviewed material test reports, and has
completed a final site inspection of the public facilities, and Hall and Hall Engineers, Inc.
recommends acceptance of these public improvements; and
WHEREAS, an acceptable 4-year maintenance bond has been submitted to the City for
the street pavement within the Prairie Creek Estates Fifth Addition; and
WHEREAS, an acceptable 4 year maintenance bond has been submitted to the City for
the other public improvements within the Prairie Creek Estates Fifth Addition, except for the
sanitary sewer, in which a 6 year maintenance bond has been submitted to the City; and
WHEREAS, Synergy Development Group, L.L.C. had established a Letter of Credit
from Guaranty Bank and Trust Company as security for the completion of the public
improvements in Prairie Creek Estates Fifth Addition; and
WHEREAS, because said public improvements in Prairie Creek Estates Fifth Addition
are acceptable to the City, and said security is no longer necessary for the completion of these
public improvements, the Letter of Credit with Guaranty Bank and Trust Company is now
considered null and void.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa, that the public improvements in Prairie Creek Estates Fifth Addition to the City of Fairfax,
Linn County, Iowa are accepted by the City of Fairfax, and the Letter of Credit between Synergy
Development Group, L.L.C. and Guaranty Bank and Trust Company is now considered null and
void.
BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the Mayor
and the City Clerk are hereby authorized and directed to execute said Resolution.
