RESOLUTION NO. 2011- 81
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING CONCERNING
VACATING A SANITARY SEWER EASEMENT
WHEREAS, the City of Fairfax, Iowa does possess a Sanitary Sewer Easement in the northerly
portion of Lot 5, Selzer’s Lakeside Addition; and
WHEREAS, the City of Fairfax has proposed to vacate the existing sanitary sewer easement on
Lot 5, Selzer’s Lakeside Addition; and
WHEREAS, the City Engineer has recommended the City require the property owner to
dedicate a new sanitary sewer easement in the northerly portion of Lot 5, Selzer’s Lakeside Addition
that is located from 10.0 feet south of and parallel to the existing sanitary sewer main to the front
property line.; and
WHEREAS, interested residents or taxpayers having comments for or against the vacation of
this Sanitary Sewer Easement may appear and be heard at the public hearing at the city council meeting
on December 13, 2011 at 7:00 PM at the Fairfax City Hall, at 525 Vanderbilt Street, Fairfax, Iowa.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa,
that this confirms that the city council orders the publication of a notice of public hearing pertaining to
the vacation of this Sanitary Sewer Easement not less than four (4) days nor more than twenty (20) days
prior to the date set for the hearing.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax, Iowa, that
the Mayor and Deputy City Clerk are hereby authorized and directed to execute said resolution.
