Home My WebLink AboutRESOLUTION NO. 2011-88 RESOLUTION NO. 2011- 88 RESOLUTION VACATING A SANITARY SEWER EASEMENT AND DEDICATION OF A NEW SANITARY SEWER EASEMENT WHEREAS, the City Council of Fairfax, Iowa does possess a 20 foot Sanitary Sewer Easement located in the northerly portion of Lot 5, Selzer’s Lakeside Addition; and WHEREAS, the City of Fairfax does not wish to have this Sanitary Sewer Easement in this exact location because the sanitary sewer main is not centered in this existing easement; and WHEREAS, the current owners of Lot 5, Selzer’s Lakeside Addition wish to place a detached garage in this existing easement area; and WHEREAS, the owners, Cory D. Stockton and Stacy J. Stockton, of Lot 5, Selzer’s Lakeside Addition are willing to dedicate a new Sanitary Sewer Easement that is located from 10.0 feet south of and parallel to the existing sanitary sewer main to the front property line of said Lot 5; and WHEREAS, no other utility companies have any utilities located in the portion of the existing Sanitary Sewer Easement that the City of Fairfax is vacating; and WHEREAS, a drawing showing the easement exhibit is attached; and WHEREAS, a public hearing was held during the city council meeting on December 13, 2011 at 7:00 PM at the Fairfax City Hall, at 525 Vanderbilt Street, Fairfax, Iowa concerning vacating this Sanitary Sewer Easement and the dedication of a new Sanitary Sewer Easement. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Fairfax, Iowa, has determined that the current Sanitary Sewer Easement located in the northerly portion of Lot 5, Selzer’s Lakeside Addition, no longer serve the public interest and said public interest and use held by the City of Fairfax in and to the property herein described is hereby vacated and that it is in the public interest to have Cory D. Stockton and Stacy J. Stockton dedicate a new Sanitary Sewer Easement that is located from 10.0 feet south of and parallel to the existing sanitary sewer main to the front property line of said Lot 5. BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute said resolution. th Passed and approved this 13 day of December, 2011.
