RESOLUTION DISPENSING WITH AN ELECTION OF THE
VOTERS TO GRANT AN ELECTRIC FRANCHISE
TO ITC MIDWEST LLC
WHEREAS, ITC Midwest has requested an electric franchise in Fairfax; and
WHEREAS, Iowa Code requires a public hearing on the proposed electrical
franchise and notice of such public hearing was published on June 1, 2012; and
WHEREAS, ITC Midwest LLC has agreed to pay the management costs of
performing this electric franchise; and
WHEREAS, the City Council of Fairfax has held the public hearing on June 12,
2012.
NOW, THEREFORE, BE IT RESOLVED,by the City Council of the City of
Fairfax, Iowa, that following the public hearing on ITC Midwest LLC's request for an
electric transmission franchise, it is determined by the City Council
(i) to dispense with an election of the voters to grant the franchise and
(ii) that the granting of the franchise will be decided by the City Council
considering an appropriate ordinance.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.
