RESOLUTION WAIVING ANY OBJECTION TO THE NOTICE GIVEN BY THE
CITY OF CEDAR RAPIDS OF ITS PENDING ANNEXATION
WHEREAS, the City of Cedar Rapids received a voluntary annexation
application for the following described property:
North of 16th Avenue SW, east of Westridge Drive SW and south of Rockingham
Drive SW and consisting of 28.072 acres, 28.956 acres including public right-of-
way (16th Avenue SW). ; and
WHEREAS,the legal description of this property is:
The West Half of the Southeast Quarter (W 1/2 SE 1/4) of Section Twenty-Seven
(27), Township Eight-Three North (T83N), Range Eight West (R8W) of the Fifth
Principal Meridian, Linn County, Iowa, EXCEPT therefrom the west six hundred
eighty-five (685) feet. ALSO EXCEPT therefrom Parcel "A" in Plat of Survey
No. Fifty-Six (56) as recorded in Book 2118 at Page 199 in the Office of the Linn
County Recorder. Subject to the public road right of way. This parcel contains
28.956 acres including and 28.072 acres excluding the public road right of way.
WHEREAS, the City of Cedar Rapids held a public hearing to consider the
proposed annexation at 12:00 PM on June 12, 2012, and. approved the annexation by
Resolution No. 0798-06-12 at that meeting; and
WHEREAS, the City of Cedar Rapids inadvertently missed sending the required.
certified letter to the City of Fairfax as notification of this public hearing concerning the
voluntary annexation; and
WHEREAS,this annexation is now pending before the City Development Board.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, that the City of Fairfax hereby waives any objection to the lack of notice
provided by the City of Cedar Rapids to the City of Fairfax regarding the proposed
annexation by Cedar Rapids as described above.
