HomeMy WebLinkAboutRESOLUTION NO. 2012-58 RESOLUTION NO. 2012-58 RESOLUTION ACCEPTING OUTLOTS A,B AND E OF PRAIRIE VIEW HEIGHTS, PHASE ONE, FAIRFAX, IOWA FOR THE PURPOSES OF ACCESS AND STORMWATER MANAGEMENT WHEREAS, Sevig Development, L.C. has developed Prairie View Heights, Phase One; and WHEREAS, as part of this development process, Sevig Development, L. C. was required to install stormwater management facilities; and WHEREAS, two of these stormwater management facilities are detention ponds located at Outlots A and B of Prairie View Heights, Phase One; and WHEREAS, Hart-Frederick Consultants, P.C. has completed an As-built review of said detention pond at Outlot A and has indicated that the storage volume in said pond is less than the design storage volume for this pond; and Hart-Frederick Consultants, P.C. also has indicated that the volume of said detention pond at Outlot A cannot be increased due to the existing residential property at 385 West Prairie Drive; and Hall and Hall Engineers, Inc. has reviewed said detention pond and the As-built review by Hart-Frederick Consultants, P.C., and recommends that an overflow spillway be cut into the northeast corner of said detention pond at Outlot A such that any overflow from said pond is directed to West Prairie Drive and away from the adjacent residential properties; and Hall and Hall Engineers, Inc. recommends that said detention pond is ready to be used for the purposes of storm water management once this overflow spillway has been constructed in a manner that will direct overflow from said pond to West Prairie Drive and away from the adjacent residential properties; and WHEREAS, Hart-Frederick Consultants, P.C. has certified that said detention pond at Outlot B would be in substantial compliance with the approved plans and specifications for Prairie View Heights—Phase One if the downstream berm is brought up to an elevation of 812.0; and Hall and Hall Engineers, Inc. has reviewed said detention pond and the certification by Hart- Frederick Consultants, P.C., and concurs that the downstream berm has been raised to an elevation of 812.0 and that said detention pond is ready to be used for the purposes of storm water management; and WHEREAS, Sevig Development, L.C. has agreed to convey to the City of Fairfax, Iowa, Outlots A, B and E, Prairie View Estates — Phase One to Fairfax, Iowa, subject to all easements, covenants, and restrictions of record for the consideration of one dollar($1.00); and WHEREAS, The City of Fairfax acknowledges receipt of all Warranty Deeds conveying the real estate for Outlots A, B and E, Prairie View Estates — Phase One to Fairfax, Iowa from Sevig Development, L.C. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, that the ponds at Outlots A and B of Prairie View Heights, Phase One, constructed by Sevig Development, L.C. for the purpose of storm water management, are hereby accepted. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, that Outlot E of Prairie View Heights, Phase One, constructed by Sevig Development, L.C. for the purpose of access to the detention pond located on Outlot E of Prairie View Heights — Phase Two, is hereby accepted. NOW, THEREFORE, BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax, Iowa that the Mayor is hereby authorized and directed to accept the Warranty Deeds for Outlots A, B and E, Prairie View Heights — Phase One for the purposes of access and storm water management, subject to all easements, covenants, and restrictions of record for the consideration of one dollar ($1.00). BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that the Mayor and City Clerk are hereby authorized and directed to execute this Resolution and record these Warranty Deeds in the office of the Linn County Recorder.
