A RESOLUTION APPROVING THE VOLUNTARY ANNEXATION
REQUEST FROM JACQUELINE STALLMAN DATED MARCH 14, 2013
FOR LOT 2, AUDITOR'S PLAT NO. 369, LINN COUNTY, IOWA INTO
THE CITY OF FAIRFAX
WHEREAS, The City Council has received a voluntary annexation application from
Jacqueline Stallman dated Match 14, 2013, for Lot 2, Auditor's Plat No. 369, Linn County, Iowa
into the City of Fairfiax; and
WHEREAS, a consultation meeting was held on April 18, 2013, at the Fairfax City Hall
at 2:00 PM on the proposed annexation, the Linn County Supervisors has not taken a position in
support of or against the voluntary annexation application; and
WHEREAS, the City Council referred this voluntary annexation application to the
Fairfax Planning and Zoning Commission for recommendation of the proper, zoning for this
property; and
WHEREAS,the Fairfax Planning and Zoning Commission met on April 16, 2013, and
took action to recommend that this property be zoning 44 RS at the time of annexation into the
City of Fairfax based on the fact that this is the zoning district that most closely matches its
current use; and
WHEREAS, a public hearing notice was published on April 29, 2013 and the public
hearing was held on May 14, 2013, at the Fairfax City Hall at 7.010 PM at that time no objections
were heard or filed,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax,
Iowa, that they have reviewed the voluntary annexation application and the Fairfax Planning and
Zoning Commission's recommendation and does hereby approve the voluntary annexation
application from Jacqueline Stallman for Auditor's Plat No. 3 69,Linn County, Iowa, and that the
initial zoning district for this property shall be 44 RS,which is the district that most closely
matches its current use.
BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that
the Mayor, and, the City Clerk/Treasurer are hereby directed to sign any necessary documents to
place the order for this vehicle and certify this resolution of approval.
