Home My WebLink AboutRESOLUTION NO. 2013-33Pairfax419915-19/Set Date2013 AmendUR Plan SET DATE FOR HEARING ON 2013 URBAN RENEWAL PLAN AMENDMENT 419915-19 Fairfax, Iowa June 25, 2013 The Council of the City of Fairfax, Iowa, met on June 25, 2013, at 7:00 o'clock, p.m., at the city hall, at 525 Vanderbilt Street, in the City, for the purpose of setting a date for a public hearing on a proposed amendment to the urban renewal plan for the Fairfax Urban Renewal Area. The Mayor presided and the roll being called, the following members of the Council were present and absent: Present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marianne Wainwright Absent: Marc Magers. The City Clerk reported that a 2013 amendment to the urban renewal plan for the Fairfax Urban Renewal Area had been prepared, in connection with proposed infrastructure improvements and the addition of property to the Urban Renewal Area, and that it was necessary to set a date for a public hearing on the proposed amendment. Accordingly, Council Member Otto moved the adoption of the following resolution entitled "Resolution setting date for a public hearing on 2013 amendment to urban renewal plan for Fairfax Urban Renewal Area," and the motion was seconded by Council Member Beer. Following due consideration, the Mayor put the question on the motion and the roll being called, the following named Council Members voted: Ayes: Beer, Frieden,^Otto, and Wainwright Nays: None. Whereupon, the Mayor declared the resolution duly adopted as follows: -I- DORSEY & WHITNEY LLP, ATTORNEYS, DES MOINES, IOWA Fairfax419915-19/Set Date2013 AmendUR Plan RESOLUTION NO. 2013-33 SETTING DATE FOR PUBLIC HEARING ON 2013 AMENDMENT TO URBAN RENEWAL PLAN FOR FAIRFAX URBAN RENEWAL AREA WHEREAS, the City Council of the City of Fairfax, Iowa (the "City") has created the Fairfax Urban Renewal Area (the "Urban Renewal Area") and has approved an urban renewal plan for the Urban Renewal Area; and WHEREAS, Chapter 403 of the Code of Iowa requires that, before a city adds property to an urban renewal area or approves any new urban renewal project, a city must amend the existing urban renewal plan to include that new project; and WHEREAS, an amendment to the urban renewal plan for the Urban Renewal Area has been prepared which describes certain property that is proposed to be added to the Urban Renewal Area and also describes the potential use of incremental property tax revenues for new urban renewal projects in connection with certain street, street lighting, sanitary sewer, storm sewer, drainage, water main and municipal trail system improvements in the Urban Renewal Area, and it is now necessary that a date be set for a public hearing on that plan amendment; NOW, THEREFORE, Be It Resolved by the City Council of the City of Fairfax, Iowa, as follows: Section 1. This City Council will meet at the city hall, at 525 Vanderbilt Street, Fairfax, Iowa, on the 23rd day of July, 2103, at 6:00 o'clock p.m., at which time and place it will hold a public hearing on the proposed urban renewal plan amendment for the Fairfax Urban Renewal Area. Section 2. The City Clerk shall publish notice of said hearing, the same being in the form attached hereto, which publication shall be made in a legal newspaper of general circulation in Fairfax, which publication shall be not less than four (4) nor more than twenty (20) days before the date set for hearing. Section 3. Pursuant to Section 403.5 of the Code of Iowa, the City Clerk is hereby designated as the City's representative in connection with the consultation process which is required under that section of the urban renewal law. -2- DORSEY & WHITNEY LLP, ATTORNEYS, DES MOINES, IOWA Fairfax419915-19/Set Date2013 AmendUR Plan Section 4. The proposed amendment is hereby submitted to the City's Planning and Zoning Commission for review and recommendations, as required by Section 403.5 of the Code of Iowa. A copy of the amendment is on file for public inspection in the office of the City Clerk. The property to be added to the Urban Renewal Area consists of approximately 105 acres located south of Cemetery Road, east of the city limits and north of the Union Pacific Railroad right-of-way. The projects include certain street, street lighting, sanitary sewer, storm sewer, drainage, water main and municipal trail system improvements along East Cemetery Road from Highway 151 to Driftwood Lane, south of East Cemetery Road at the sewer lift station, through Arp's property south of East Cemetery Road to Prairie Creek, south of East Cemetery Road along a Prairie Creek tributary to Prairie Creek, north of East Cemetery Road to Casey's property, and on 80th Street from East Cemetery Road to Creek Side Drive. At the hearing any interested person may file written objections or comments and may be heard with respect to the subject matters of the hearing.
