RESOLUTION NO. 20X3-35
RESOLUTION ACCEPTING THE REMAINDER OF THE PARK
IMPROVEMENTS (OTHER THAN THE MULCH AND PLANTINGS IN
THE RAIN GARDEN'S AND SOME OF THE PLANTINGS IN THE
LANDSCAPE BERMS) IN THE FAIRFAX CITY PARK AND ATHLETIC
FIELD COMPLEX
WHEREAS, the City Council of Fairfax, Iowa has contracted with Dave Schmitt
Construction Co.. Inc. for the Fairfax. City Park and.Athletic Field Complex, within the corporate
limits and
WHEREAS, the City Council of Fairfax, Iowa has previously accepted the
baseball/softball and soccer fields, field lighting, southeast parking lot, batting cages, trash
enclosure, playground pad, and the 5" PCC in the playground pad; and
WHEREAS, Hall and Hall Engineers, Inc. has certified that said rest of the Fairfax City
Park and Athletic Field Complex. Project (other than the mulch and plantings in the rain gardens,
and some of the plantings in the landscape berms) has now been completed in substantial
compliance with the plains and specifications.
NOW, TIIL+"+"REFORE, BE IT RESOLV+D, by the City Council of the City of Fairfax,
Iowa, that the rest of the park improvements (other than the mulch and plantings in the rain
gardens, and some of the plantings in the landscape berms) in the Fairfax City Park and Athletic
Field Complex, constructed by Dave Schmitt Construction Co. Inc., are hereby accepted.
BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that.
$5,000 of the retainage is hereby kept until the mulch and plantings in the rain gardens and the
plantings in the landscape berms are completed to the City's satisfaction.
BE .IT .FURTHER RESOLVER, by the City Council of the City of Fairfax, Iowa, that
the Mayor and City Clerk are hereby authorised and directed to execute this Resolution.
