HomeMy WebLinkAboutRESOLUTION NO. 2014-02 RESOLUTION NO. 2014-02 RESOLUTION ESTABLISHING WATER NIAIN CONNECTION FEES RELATIVE TO THE 2013 PHASE 1 EAST CEMETERY ROAD RECONSTRUCTION, DRAINAGE, STORM SEWER, WATER MAIN, AND SANITARY SEWER PROJECT L WHEREAS, the City of Fairfax has constructed a water main facilities project known as the 2013 Phase 1 East Cemetery Road Reconstruction, Drainage, Storm Sewer, Water,M,ain, and Sanitary Sewer Project; and. WHEREAS, said water main facilities project provides potential water supply service to a number of properties lying along East Cemetery Road and Highway 151 (Williams Blvd.); and WHEREAS, the City of Fairfax has determined that portions of the costs of said water main facilities project shall be reimbursed to the City in the form of connection fees in accordance with Chapter 40.06 CONNECTION FEE of the City's Code of Ordinances; and WHEREAS, the City Engineer has calculated the cost of this water main facilities project and the fees for connecting property within this project's limits to the City's water mains that are part of this project. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, the following: 1. Water Main Connection Fees for the 2013 Phase I East Cemetery Road Reconstruction, Drainage, Storm Sewer, Water Main, and Sanitary Sewer Project shall be as follows: a. The Connection Fee shall be determined by the property line frontage lying adjacent to City's water main, and shall be set as $15.345C1Y of property frontage. b. The Cortnection Fees established above shall increase at an annual interest rate of 2.5% for a period of 12 years after the approval of this resolution.. The first year, calendar year 2014, there shall be no interest applied to these Connection Fees. After the 12'h year, effective January 1, 2026, the Connection Fees shall be fixed and shall not increase after this point. c. The City maintains the right to adjust the connection fees for properties that are fronted by the City's water main on more than one side of the parcel. One practice may be to average the frontage of all sides of the property that are adj acent to the public water main.. 2. For water services and/or water mains larger than 1 in, in diameter, the City shall also charge a tapping fee in addition to the water main connection fee .for water services/water mains connecting to the City's water train installed as part of this 2013 Phase 1 East Cemetery Road Reconstruction, Drainage, Storm Sewer, Water Main, and Sanitary Sewer Project. These tapping fees shall be as follows: a. Up to, incl. 1"dia. water service---No Additional Tapping Fee b. Up to, incl. "dia. water service—$250.00 c. Up to, incl, 3"dia. water service—$550.00 d. Up to, incl. 4" dia. water service—$990.00 e. Up to, incl. 5" dia. water service_w$1,580.00 f. Up to, incl. 6" dia, water service,,-$2,220.00 g. Up to, incl. 8" dia. water service—$4,000.00 h. Up to, incl. 10" dia. water service—$6,400.00 i. Up to, incl. 12"dia, water service—$9,000.00 3. The City maintains the right to pass on any and all costs that the City may accumulate as pant of a water service / water main connection to the property owner benefiting froth this connection. 4. The water main Connection Fees and Tapping Fees shall be paid to the City Clerk by the applicant prior to the issuance of a building permit or prior to the applicant's connection to the City's water main.
