RESOLUTION ESTABLISHING SANITARY SEWER
CONNECTION FEES RELATIVE TO THE 2013 PHASE I EAST
CEMETERY ROAD RECONSTRUCTION, DRAINAGE, STORM
SEWER, WATER MAIN, AND SANITARY SEWER PROJECT
WHEREAS, the City of Fairfax has constructed a sanitary sewer project known
as the 2013 Phase I East Cemetery Road Reconstruction, Drainage, Storm Sewer, Water
Main, and Sanitary Sewer Project; and
WHEREAS, said sanitary sewer project provides potential sanitary sewer service
to a number of properties (developed and undeveloped) lying primarily along East and
West Cemetery Roads and also lying primarily north of East and West Cemetery Roads
and west of 80th Street; and
WHEREAS, said potential sanitary sewer service area shall be Down as the
Cemetery Road -- 80t" Street Drainage Basin, which consists of approximately 2,040
acres and is currently located partly within the City of Fairfax, and partly in Linn County,
and
W11EREAS, the City of Fairfax has determined that portions of the costs of said
sanitary sewer project shall be reimbursed to the City in the form of connection fees in
accordance with Chapter 96.02 CONNECTION FEE of the City's Code of Ordinances;
and
WHEREAS, the City Engineer has calculated the cost of this sanitary sewer
project and the fees for connecting property within the Cemetery Road — 80'i' Street
Drainage Basin to the City's sanitary sewer(s) that are part of this project or a future
extension of this project.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax., Iowa,the following:
1. Sanitary Sewer Connection Fees for the 2013 Phase 1 East Cemetery Road
Reconstruction, Drainage, Storm Sewer, Water Main, and Sanitary Sewer
Project within the Cemetery Road — 8Ctt' Street Drainage Basin shall be as
follows:
a. The Connection Fee shall be determined by the entire size of the
property that is connecting to the City's Sanitary Sewer, and shall be
set as$484.380acre.
b. The Connection Fee shall also include the cost of the sanitary sewer
service that was installed to the property line as parr of this project.
This fee shall be $1,233.8211ot. If there was not a service extended to
the property line as part of this project, than the property owner is
responsible for installing their own sanitary sewer service to the City's
sanitary sewer plain, and this fee shall not apply.
c. The Connection Fees established above shall increase at an annual
interest rate of 2.5% for a period of 12 years after the approval of this
resolution. The first year, calendar year 2014, there shall be no
interest applied to these Connection Fees. After the 121'year, effective
January 1, 2026, the Connection Fees shall be fixed and shall not
increase after this point.
d. This sanitary sewer project has been constructed to convey wastewater
from the Cemetery Road — 80'h Street Drainage Basin based upon its
side (approximately 2,040 acres) and the City's Land Use Map for this
area at the time it was designed and constructed in 2013. The City's
Land Use Map in effect at this time did not fully extend to the 'upper
portions of the Cemetery Road — 80'4 Street Drainage Basin, so the
proposed Residential Land Use indicated north of Highway 151 as
shown on this Land Use Map at this time was assumed for the upper
portions of this basin as well. If a property develops at a more
intensive use than planned for in the City's Land Use Map, or if a
property outside of the Cemetery Road — 801h Street Drainage Basin
connects to this portion of the City's Sanitary Sewer System, than the
City maintains the right to collect an increased Sanitary Sewer
Connection..Fee at the City's discretion.
2. The Sanitary Sewer Connection Fees shall be paid to the City Clerk by the
applicant prior to the approval by the City of the final plat. if the proposed
sanitary sewer connection is not part of a platted subdivision for which
sanitary sewer connection fees have been paid, than the connection fees shall
be paid prior to the issuance of a building permit or prior to the applicant's
connection to the City's sanitary sewer main.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer .are hereby authorized and
directed to execute said resolution.
