A RESOLUTION APPROVING AND MAKING AWARD OF CONTRAC T ,FOIL,THE
PHASE 2®,LAST CEMETERY ROAD S'i REET RECONSTRIJC"r11ON, TRAIT,/,AND
DRAINAGE IMPROVEMENTS PROJECT
WHEREAS, the City Council of the City of Fairfax, Iowa, did receive bids on Thursday,
February 6, 2014, at 10:00 AM for the Phase 2 — East Cemetery Road Street Reconstruction,
Trail, and Drainage Improvements Project; and
WHEREAS, the City Council of the City of Fairfax., Iowa, did approve the plans,
specifications, form of contract, and estimated cost for the Phase 2 — East Cemetery Road Street
Reconstruction, Trail, and Drainage Improvements Project on February 11, 2014.
NOW, THERE BE IT RESOLVED, by the City Council of the City, of Fairfax,,
that the quote from Rathje Construction Company in the amount of$973,267.26 for the Phase 2
—East Cemetery Road Street Reconstruction, Trail, and Drainage Improvements Project, be and
is hereby accepted, as the lowest responsible quote received, and a contract is hereby awarded;
and
BE IT FURTHER RESOLVED, that the contractor is hereby instructed to promptly
execute the construction contract and return the same to the Mayor along with all the supporting
documents required therein, including surety bond covering work to be performed and proof of
satisfactory insurance coverage; and
BE IT FURTHER RESOLVED, that the Mayor, with the assistance of the City j
Engineer is thereafter directed to examine the contract for proper execution and all supporting
documents, including surety, bond and proof of insurance coverage to determine satisfactory
compliance with contract specifications. If all documents are in order, the Mayor shall approve
the same in writing and place written approval on file in the office of the City Clerk/Treasurer;
and
BE IT FURTHER RESOLVED, that the Mayor and City Clerk/Treasurer are hereby
authorized and directed to execute the contract for and on behalf of the City and upon execution
the contract shall be in full force and effect; and
BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax., Iowa, that
the Mayor aiid. City Clerk/Treasurer are hereby authorized and directed to execute said.

RESOLUTION TO APPROVE PAY APPLICATION NO. 4 FROM
RICKLEFS EXCAVATING,LTD FOR PHASE 1 EAST."CE +'TERY ROAD
RECONSTRUCTION,DRAINAGE, STORM SEWER,WATER MAIN,AND
SANITARY SEWER PROJECT IN FAIRFAX,LINN COUNTY, IOWA
WHEREAS, the City Council of Fairfax, Iowa has contracted with Ricklefs
Excavating, LTD, for the Phase 1 East Cemetery Road Reconstruction, Drainage, Storm
Sewer, Water Main, and Sanitary Sewer Project within the corporate limits; and
WHEREAS, Hall and Hall Engineers, Inc., has recommended approval of Pay
Application No. 4 from Ricklefs Excavating, LTD. for a current payment dueof
$96,718.93.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, to approve Pay Application No. 4 from Ricklefs Excavating, LTD. for the
Phase l East Cemetery Road Reconstruction, Drainage, Storm Sewer, Water Main, and
Sanitary Sewer Project and issue a check for$96,718.93.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.

WHEREAS, the sanitary sewer connection fee for the above mentioned property shall be �

The following conditions are a part of this agreement, and shall be applicable to this
property:
1. This connection fee shall b8@one-time fee and shall befor one service connection
to the City's public sanitary sewer system for the property identified above.
2. This connection fee does not replace or diminish the [itysmastmvvmter (sewer)
usage fee for this property. The Owner, ortheir tenants, renters, etc. shall be
responsible to pay their wastewater usage fee in a prompt and timely manner.
3. The Owner shall be fully responsible for extending their sanitary sewer service t0the
City's public sanitary sewer system and for connecting to the City's public sanitary
sewer system.
4. The Owner shall coordinate with the City's maintenance/building department prior
tnconnecting the City's public sanitary sewer system.
