RESOLUTION ACCEPTING A 50' DRAINAGE AND STORM SEWER
EASEMENT ONA POR'T'ION OF THE PROP ='RTY LOCATED EAST OF 25
EAST CEMETERY ROAD AND SOUTH OF EAST CEMETERY ROAD IN
CONNECTION WITH THE PHASE 2 EAST CEMETERY ROAD STREET
RECONSTRUCTION, TRAIL AND DRAINAGE IMPROVEMENTS PROJECT
IN FAIRFAX,LINN COUNTY, IOWA
WHEREAS, Hall &Hall Engineers has determined the need for a 50' wide
Drainage and Storm Sewer Easement for construction of the Phase 2 East Cemetery Road
Street Reconstruction, Trail and Drainage Improvements project; and
WHEREAS, Regis L, Arp and Kenneth eth J. Ail), OWNERS of the real property
known and described as follows:
Northwest Quarter of the Southwest Quarter of Section 1.0, Township 82 North,
Range 8 West of the 5th Principal Meridian, Linn County, Iowa
have agreed to convey the necessary easement for drainage and storm sewer along a
portion of the above real property to the City for consideration of $1.00 and other
valuable considerations; and
WHEREAS,Hall &Mall Engineers recommends the City enter into an,
agreement to purchase the easement for drainage and storm sewer in accordance with the
terms set forth in the Purchase Agreement.
NOW,THEREFORE, BE IT RESOLVED,by the City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute the Purchase Agreement as described herein, and
BE IT FURTHER RESOLVED,by the Fairfax City Council of the City of
Fairfax, Iowa, that the 50' Drainage and Storm Sewer Easement be accepted and
recorded in the Office of the Lirm County Recorder,
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/`l"reasurcr are hereby authorized and
directed to execute said resolution.
