HomeMy WebLinkAboutRESOLUTION NO. 2014-44 RESOLUTION NO. 2014-44 RESOLUTION ESTABLISHING PARK FEES WHEREAS, the City of Fairfax has several park facilities that are available for use; and WHEREAS, some local groups will be allowed to have free use of some of the park facilities and other groups will be charged rental fees for the use of some of the park facilities; and WHEREAS, the City of Fairfax needs to establish the park fee schedule and procedure for collection of these fees; and WHEREAS, the Fairfax Youth Sports Association (FYSA) has agreed to participate in this process. NOW, THEREFORE, BE IT RESOLVED that the Fairfax City Council does hereby establish the following schedule of fees and procedure for reservations of the City of Fairfax park facilities: Prairie Creek Park Pavilion—free use. Reservations can be made through the city clerk's office. The name, date, and time of the reservation will be posted prior to the date. Hawks Ridge Park Pavilion - free use. Reservations can be made through the city clerk's office. The name, date, and time of the reservation will be posted prior to the date. City Park Pavilion - free use. Reservations can be made through the city clerk's office. The FYSA schedule will be consulted before the reservation is made. The name, date, and time of the reservation will be posted prior to the date. Fairfax Regional Sports and Park Complex Pavilion - free use. Reservations can be made through the city clerk's office. The FYSA schedule will be consulted before the reservation is made. The name, date, and time of the reservation will be posted prior to the date. Greg Fetter Field at City Par — free use for the Fairfax Men's League, FYSA, and the Fairfax USA Day Committee. Park users may use the diamond when not in use by a scheduled, organized activity, but there will be no field maintenance, equipment, or support supplied. The following schedule of rental fees shall be charged to all other groups: $20.00 per practice $50.00 per game—(single games, double headers, and tournaments) Groups paying to use the diamond must provide a certificate of insurance prior to the use with the following provisions. 1. Name the City of Fairfax and Fairfax Youth Sports Association as also insured on their liability insurance. 2. Provide liability insurance in amounts not less than $2,000,000 aggregate and $1,000,000 per occurrence; products and completed operations insurance not less than $1,000,000; and medical expense insurance not less than $5,000. 3. Agrees to assume full and absolute responsibility for, and to defend, hold harmless and indemnify the City of Fairfax and Fairfax Youth Sports Association and its officers, volunteers, agents, and employees for any and all claims, damages, and losses to persons or property in any way resulting from the care, operation, or use of the area and activities covered by this rental. Reservations must be made through FYSA. Any checks for rental fees will be made payable to the City of Fairfax and turned into the city clerk's office as soon as possible after receipt of the payment. FYSA shall monitor the use and collect the appropriate charge. Youth Baseball/Softball Diamonds at City Park and Fairfax Regional Sports and Park Complex— free use for FYSA and the Fairfax USA Day Committee. If the Fairfax City Council determines to allow park users to use a diamond when not in use by a scheduled, organized activity, there will be no field maintenance, equipment, or support supplied. The following schedule of rental fees shall be charged to all other groups, per field: $20.00 per practice $50.00 per game—(single games, double headers, and tournaments) $25.00 per hour of field lights usage Groups paying to use the diamond must provide a certificate of insurance prior to the use with the following provisions. 1. Name the City of Fairfax and Fairfax Youth Sports Association as also insured on their liability insurance. 2. Provide liability insurance in amounts not less than $2,000,000 aggregate and $1,000,000 per occurrence; products and completed operations insurance not less than $1,000,000; and medical expense insurance not less than $5,000. 3. The following schedule of rental fees shall be charged to all other groups, per field: $10.00 per practice $50.00 per game—(single games and tournaments) Groups paying to use a field must provide a certificate of insurance prior to the use with the following provisions. 1. Name the City of Fairfax and Fairfax Youth Sports Association as also insured on their liability insurance. 2. Provide liability insurance in amounts not less than $2,000,000 aggregate and $1,000,000 per occurrence; products and completed operations insurance not less than $1,000,000; and medical expense insurance not less than $5,000. 3. BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that the Mayor and City Clerk are hereby authorized and directed to execute said Resolution.
