RESOI'.,UTION EXECUTING AN AGREEMENT FOR.DETENTION BASIN
REPAIRS AT THE NO'RTHEAS'T' CORNER OF 80,111 STREET AND EAST
CEMETERY ROAD IN CONNECTION WITH THE PHASE 2 EAST
CEMETERY ROAD STREET RECONSTRUCTION, TRAIL AND DRAINAGE
IMPROVEMENTS PROJECT IN FAIRFAX, LINN COUNTY, IOWA
WHEREAS, as part of platting Prairie Creek Estates First Addition in the City
of Fairfax, Iowa (hereinafter referred to as the CITY), Synergy Development Group,
LLC, (hereinafter referred to as the DEVELOPER) reserved the following described
parcel for a stormwater detention facility to be owned by the CITY:
LOT `A' of Prairie Creek Estates First,Addition in the City of Fairfax, 'Linn
County,Iowa, and
WHEREAS, the storinwater detention facility has not been accepted by the CITY
as it currently does not drain correctly and is in need of repair's,and
WHEREAS, said repairs were included in the Phase 2 East Cemetery Road Street
Reconstruction, Trail, and Drainage Improvements project,and
WHEREAS,Hall &Hall Engineers recommend the CITY enter into an
Agreement with the DEVELOPER regarding reirnbursenient of the cost of said repairs
and,acceptance of the stormwater detention facility.

NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute the Agreement for Detention Basin Repairs as described herein, and
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.

AGREEMENT FOR DETENTION BASIN REPAIRS
WHEREAS, as part of platting Prairie Creek Estates First Addition in the City of Fairfax,
Iowa, (hereinafter referred to as the CITY), Synergy Development Group, LLC, (hereinafter
referred to as the DEVELOPER) reserved the following described parcel for a stormwater
detention facility to be owned by the CITY:
LOT'A' of Prairie Creek Estates First Addition in the City of Fairfax, Linn County, Iowa
and
WHEREAS, prior to accepting ownership of said property the CITY requires the
DEVELOPER repair said stormwater detention facility to allow for adequate drainage, and
WHEREAS,the CITY has the Phase 2 East Cemetery RoadStreet Reconstruction,Trail,
and Drainage Improvements construction project in the area, and
WHEREAS,the following bid items were included in said construction project to be
paid by the DEVELOPER for repair of the stormwater detention facility:
Subdrain, 6" (Within Detention Basin) 150 LF at$9.75 per LF $1,462,50
Subdrain,Cleanout, 24 In. Dia 1 Each at$770.00 per Each $770,00
Total Detention Basin Repair Cost =$2,232.50
NOW THEREFORE BE IT RESOLVED,that the DEVELOPER agrees to reimburse the CITY
the amount of$2,232.50 for repairs to stormwater detention facility,and
THEREFORE BE IT FURTHER RESOLVED, that upon receipt of payment from the
DEVELOPER and completion of repairs,the CITY shall accept the stormwater detention facility
and assume all future maintenance and repairs.
