HomeMy WebLinkAboutRESOLUTION NO. 2014-64 SOLUTION NO. 2014-64 A RESOLUTION TO ORDERING SIDEWALK INSTALLATION WHEREAS, the City Council of Fairfax has the power to order sidewalk installation according to Section 136.06 of the City of Fairfax Code of Ordinances 2012; and WHEREAS, the City Council of Fairfax has the power to order sidewalk repair according to Section 136.05 of the City of Fairfax Code of Ordinances 2012; and WHEREAS, the City Council has reviewed a listing of property without sidewalks; and WHEREAS, the City Council wishes to order sidewalk installation at the following properties: Owner's Name Location.Address David and Lori Tonsfeldt 204 Sunflower Amrik and Satwinder Shangu 207 Sunflower Karl and Judith Bush 112 Ridge Drive Richard Schaefer 114 Ridge Drive Guaranty Bank 300 80th Street Court Guaranty Bank 325 80th Street Court Artistic Glass 315 80th Street Court Scott and Laura Konecny 123 Ridge Drive (along Ridge Drive only-for now) Larry Cbmelieek. 302 Ridge Drive Washmobr Fairfax I.LC:" 400 Highland (connect to existing sidewalk:) NOW, THEREFORE, BE IT RESOLVED, that the Fairfax City Council does hereby order sidewalk installation at the properties listed above; and BE IT FURTHER RESOLVED, that the Fairfax City Council hereby instructs staff to send sidewalk installation notices with an installation deadline of September 1, 2014; and BE IT FURTHER RESOLVED, any such ordered sidewalk installation not completed by September 1, 2014, may be completed by the City of Fairfax, using staff or contractor, with all expenses billed to the property owner and collectable as property taxes, if needed; and BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that: the Mayor and City Clerk are hereby directed to certify this resolution. Detention area on Highland Avenue across from the cap wash(we are getting a bid froom Menta Concrete.for this area) Approved Quote 6-10-14 2. Area along Coneflower (welcome sign property) -this sidewalk would dead end into the State's right of way. There is sidewalk on the other side of Coneflower. No 1 Detention area near the planned Meadow Oak Addition, along Prairie View Drive. See how the sidewalk works when installed to connect the development. 4. Detc on area'at E Cemetery Road and'Driftwood Lane, along Darittwooa Lane.. Requested a quote for installation for the July meeting. Private PropertAreas: 1. David and Lori Tonsfeldt, 903 Aster Court—they own the lot behind them, at 204 Sunflower Drive. It is mowed lake their lawn,they have a garden on part of it, and it is a separate legal parcel. They have owned it since 2013. This is a corner lot (Sunflower Drive and Goldenrod Drive) and it has sidewalk coming up to it from both sides. Yes 2. Amrik & Satwinder Shangu, 135 Bluff Drive—they own the lot behind them, at 207 Sunflower Drive. It is snowed and is a separate legal parcel. They have owned it since 2008. It has sidewalk corning up to it from both sides. Yes 3. Patrick Slater, 195 Bluff Drive. There isn't sidewalk along the 2"d Street side of the property. The lot behind them(907 2nd Street or 219 Sunflower Drive) is vacant. Dave said he believes there was a written agreement to not require sidewalk along 2 d Street until that lot is built upon. Not until lot behind them is built on. 4. Karl & Judith Bush,Inter Vivos Trust, 4904 Sunset Drive SW, Cedar Rapids—they own the lot behind them, at 112 Ridge Drive, this is a separate legal parcel. It is mowed and has trees planted. There is sidewalk coming from 110 Ridge Drive, but 114 is also vacant, mowed, and owned by someone out of the city limits, so there isn't sidewalk coming from 114. They have owned this since 2007. Yes 5. Richard Schaefer, 402 Date Street, Williamsburg—they own 114 Ridge Drive. This is mowed and has trees planted. There is no sidewalk from 112 Ridge (see above) but there is from 116 'Midge. They have owned since 2007. 112 and 11.4 look like they are maintained/planted as one lot. Yes 6. Guaranty Bank, 300 80"' Street Court. They need to finish their part around the circle at 300..:and 325..:80th' Street Court. Yes 7. Artistic Glass, 315 8W Sii6et Court. They need to install their part around the circle. Yes �8. Scott and Laura Konecny, 119 Ridge Drive—they own 123 Ridge Drive, next door. This, is mowed, This is a comer lot and a separate legal parcel.. They have sidewalk coining from 119 Ridge. 923 Goldenrod.is still owned.by Gordon Sevig and vacant. They have owned this since April of 2014. Yes, but only along Ridge Drive for now. Rest when lot behind is built upon., 9. Larry Chmelicek, 5325 Harbet Avenue,NW, Cedar Rapids—he owns 302 RidgeDfive. This is mowed. He has owned it since 2006. Yes 10. Doug ExIine, 402 Sunset Drive. He has sidewalk along one side of his property, but not the other. It is a corner lot. The side without sidewalk goes to the end of the city limits. No 11. Greg or Christine Gerdes, 399 Prairie View Circle. They have sidewalk along one side of their property, but not the other. It is a corner lot. The side without sidewalk goes to the end of the city limits. This is across from ExIine's property. No 12. Novak Electric, Inc,vacant property at 440 Highland Avenue. This lot is mowed. They have owned it since 2005. One end leads to the State right of way, one end leads to the car wash property. No 13, Washmohr Fairfax LLC, car wash at 406 "14ighlan' d:Avenue. They have their parking lot black topped cleart to the curb with no sidewalk designated. Yes, but only to install a small section for the sidewalk to connect the parking lot and the sidewalk coming from the next property. There are many areas in the original part of Fairfax that do not have sidewalk. I did not list these areas at this time,due to the extensive list and major decisions that would need to be made. Many of the areas have drainage ditches that would require city storm sewer before sidewalk could be placed. Along 801h Street and East Cemetery Road there are properties without sidewalk along one side or the rear of their properties. These areas have drainage ditches that would make sidewalk placement difficult. These properties were not placed on the list. The City of Fairfax does not currently have a"sidewalk policy". We do have a sidewalk standards ordinance. This ordinance requires sidewalk permit be issued. I'm told we have never done this, other than make the sidewalk part of the new construction building permit. Requiring a permit (even for free) gets them in here and us a chance to hand them the sidewalk standards for construction, The ordinance defines "defective sidewalk" and states that property owners must repair, replace, or reconstruct broken or defective sidewalks. The City is not currently doing any inspections and sending notices for repair work that needs to be completed. The ordinance gives the City Council the power to order repairs or sidewalk construction.
