HomeMy WebLinkAboutRESOLUTION NO. 2014-79 IRESOLUTiON NO. 2014-79 I A RESOLUTION TO ENTER INTO AN AGREEMENT WITH RAY'S EXCAVATING-,. LLC FOR STREAM CHANNEL FLOOD REPAIR WORK WHEREAS, the stream channel located along the shared property line between Eastern Iowa Building's (EIB) property(Lot I and Outlot A of Sobaski's Addition in the City of Fairfax, (Linn County, Iowa, and The City of Fairfax's (CITY) property (Lot A of Arp's Meadows First Addition in the City of Fairfax, Linn County, Iowa) was damaged with the flooding from the June 29th and 30th, 2014 storm events. This flooding caused damage to the embankments along EIB's property on the west side of this stream, and damage to the embankments along the CITY's property on the east side of this stream. The stream channel was relocated in some places along the section of the stream shared,by these properties, and sediment and debris (trees, shrubs, etc.) was deposited along this stream channel. This project is specific to the work required to clean and remove the sediment and debris from the stream channel and dispose of it off-site. This PROJECT does NOT include any work involved with re-establishing the stream embankments along either the EIB property on the west side of this stream or the CITY's property on the east side of this stream, or re-aligning the stream channel to its original alignment immediately before the storms of June 29th and 30th, 2014; and WHEREAS, EIB had obtained Bushman Excavating to repair the embankments along EIB's side of the Stream and to remove sediment from some portions along the stream chancel that had been deposited from the flood. This work, was done separately from this agreement; and, WHEREAS, Ray's Excavating, LLC (CONTRACTOR) is currently providing earthwork services as a sub-contractor for Taylor Construction on the trail and pedestrian bridge project that is currently underway on the CITY's Property. Ray's Excavating has provided hourly rates and a total estimate to remove most of the sediment and debris that remains along this stream channel, after Bushman Excavating has removed some of the sediment and debris with their work for EIB. The total estimate submitted by Ray's Excavating to complete this work is $20,000,00, The hourly rates and estimates are attached; and WHEREAS,the work to be performed on this PROJECT is anticipated as follows: (The North Stream Section is considered from the Highway 1.51 flood repair project to the upper end of the Stream's Curve Section where the stream turns south and. the large washout on the CITY's property has occurred; the South Stream Section is considered from the lower end of the Stream's Curve Section to Prairie Creek) Sediment and Debris Clean-up and Removal from the Stream Channel at the following locations*: Along the North Stream Section on the CITY's side of the stream channel • Along the Stream Curve Section on EIB's side of the stream channel** w Along the South Stream Section on the CITY's side of the stream channel Into Prairie Creek on BOTH sides of the stream.. *' All sediment and debris shall be removed from the site and deposited off-site. The Repairs to the Washout along the CI I"Y's property in the Stream Curve shall be completed as part of the City's Trail and Pedestrian Bridge project, and NOT as part of this PROJECT; and WHEREAS, the work to be performed shall be paid for on an hourly basis. The CONTRACTOR shall coordinate with the CITY to bring this project to completion and to keep the project costs in line with the estimate submitted by the CONTRACTOR for this PROJECT. The CONTRACTOR shall not perform any work on this PROJECT beyond the total project estimate provided ($20,000.00),until the following occurs: • The CONTRACTOR coordinates with the CITY about approaching or reaching the estimated project cost; • The CONTRACTOR provides the CITY with a list: of the work that remains to be completed, and the additional cost estimate to complete this remaining work. • The CITY approves this additional work.and costs; and WHEREAS, Hall and ball Engineers has drafted an agreement and is recommending the City of Fairfax enter this agreement. NOW, THEREFORE, BE IT RESOLVED, that the City of Fairfax agrees to enter into an agreement with Ray's Excavating, LLC for stream channel flood repair work. BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that the Mayor and City Clerk are hereby directed to certify this resolution of approval and the Mayor and City Clerk are authorized to sign the Agreement for Stream Channel .Flood Repair Work between the City of Fairfax and Ray's Excavating, LLC.
