CONCERNING THE TRAIL AND PEDESTRIAN BRIDGE PROJECT WHEREAS, the City of Fairfax has contracted with Taylor Construction, Inc. for a trail and pedestrian bridge project; and. WHEREAS, the trail and pedestrian bridge project is substantially completed; mid WH +`IZEAS, the City of Fairfax wishes to have the trail and. pedestrian bridge open for public use; and WHEREAS, Taylor Construction, Inc. is responsible for the project area until fully completed and accepted by the City of Fairfax; and WHEREAS, Taylor Construction, Inc. is requiring the City of Fairfax to enter into the attached Hold Harmless Agreement before opening the area for public use. NOW, THEREFORE,,BE IT RESOLVED, that the City of Fairfax agrees to enter into the attached Hold Harmless Agreement with. Taylor Construction pending approval by the City of Fairfax's insurance agent,and attorney. BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that the Mayor and City Clerk are hereby directed to certify this resolution of approval and the Mayor and City Clerk are authorized to sign the Hold Harmless Agreement with Taylor Construction, Inc. after receiving approval from the City of Fairfax's insurance agent and attorney.
