R,ESOLUTION SETTING THE TIME AND PLACE FOR APUBLIC
HEARING FOR THE PURPOSE OF SOLICITING WRITTENAND
ORAL COMMENTS ON VACATING AN UTILITY EASEMENT
WHEREAS, the City of Fairfax has received a request to combine four existing
lots (Lots 110, 111, 112, and Lot 129 of Prairie View Heights, Phase Two, Fairfax, Iowa)
all within the City of Fairfax, Iowa, into three lots; and
WHEREAS, as part of this process they have requested that the utility companies
in Fairfax and the City of Fairfax vacate an existing utility easement centered along the
shared side yard property line of Lots 110 and 129 of Prairie View Heights, Phase Two,
Fairfax Iowa; and
WHEREAS, Iowa Code requires a public hearing concerning vacation of this
utility easement; and
WHEREAS, interested residents or taxpayers having comments for or against the
proposed utility easement vacation may appear and be heard at the public hearing at the
city council meeting on January 27, 2015, at 6:00 PM at the Fairfax City Hall, at 525
Vanderbilt Street, Fairfax, Iowa.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, that this confirms that the city council order the publication of a notice of
public hearing pertaining to this utility easement vacation request.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.
