HomeMy WebLinkAboutRESOLUTION NO. 2015-04 RESOLUTION NO. 2015-04 RESOLUTION APPROVING THE FINAL PLAT FOR PRAIRIE VIEW HIGHTS SECOND ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA WHEREAS, a Final Plat of Prairie View Heights Second Addition in the City of Fairfax, Linn County, Iowa, a Replat of Lots 110, 111, 112, and 129 of Prairie View Heights, Phase Two, Fairfax, Iowa has been submitted to the City of Fairfax by Sevig Development, LC, Gordon Sevig; and WHEREAS, Hall and Hall Engineers, Inc. has reviewed said Final Plat of Prairie View Heights Second Addition in the City of Fairfax, Linn County, Iowa, a Replat of Lots 110, 111, 112, and 129 of Prairie View Heights, Phase Two, Fairfax, Iowa, dated January 21, 2015, and has found said Final Plat to be in accordance with the provisions of the laws of the State of Iowa and the ordinances of the City of Fairfax, Iowa, in relation to the related development within the City of Fairfax, and has further recommended approval of said Final Plat. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, that the Final Plat of Prairie View Heights Second Addition in the City of Fairfax, Linn County, Iowa, a Replat of Lots 110, 111, 112, and 129 of Prairie View Heights, Phase Two, Fairfax, Iowa, is hereby acknowledged and approved on the part of the City of Fairfax, Linn County, Iowa. DEVELOPMENT AGREEMENT This Development Agreement(this"Agreement") is entered into this g 1 day of January, 2015, by and between the undersigned property owner(hereinafter referred to as the DEVELOPER) and the City of Fairfax, Linn County, Iowa (hereinafter referred to as the CITY). RECITALS 1. The DEVELOPER is owner of the following described property: See Attached Exhibit"A" 2. The DEVELOPER proposes to record a final plat situated on a portion of the Real Estate to be known as Prairie View Heights Second Addition in the City of Fairfax, Linn County, Iowa (a Re-plat of Lots 110, 111, 112, and 129 of Prairie View Heights Phase Two)and has prepared a proposed final plat of such addition (the"Plat"). Said Addition shall consist of Lot 1 through Lot 3, all inclusive. NOW BE IT RESOLVED,the DEVELOPER and the CITY hereby agree as follows: 1. The DEVELOPER and any contractor or other agent employed by the DEVELOPER shall provide insurance as reasonably required by the CITY when working within the public rights-of-way. 2. THAT PRIOR TO THE ISSUANCE OF A FINAL CERTIFICATE OF OCCUPANCY for Lots 1 and 2,the storm water drainage swale shall be installed within the Storm Water Drainage Easement and stabilized with permanent ground cover. 3. THAT PRIOR TO THE ISSUANCE OF A FINAL CERTIFICATE OF OCCUPANCY for Lots 1 and 2,through which overland conveyance of the 100-year storm event will occur,the DEVELOPER shall provide certification by a civil engineer licensed in the State of Iowa verifying the runoff from the 100-year storm event can be conveyed through the proposed Lots 1 and 2 without damage to the building structures. 4. The Minimum Low Openings for Lots 1 and 2 have been determined to be 804.0(NAVD 1988). 5. The DEVELOPER shall own and maintain the storm water drainage swale located within the Storm Water Drainage Easement,which shall convey the 100-year storm event overland through Lots 1 and 2. The DEVELOPER also agrees not to restrict the overland conveyance of the 100-year storm event through this drainage swale. 6. PRIOR TO GRADING THE STORM WATER DRAINAGE SWALE,The DEVELOPER and any contractor or other agent employed by the DEVELOPER shall be responsible to coordinate with the local utility companies and the CITY to confirm utility locations and schedule any utility work/observation that may be necessary prior to and/or during the construction of this swale. The DEVELOPER shall be responsible for all costs related to any utility work or relocations. 6. THAT PRIOR TO THE ISSUANCE OF A CERTIFICATE OF OCCUPANCY, the property owner shall be responsible to construct 4' wide concrete sidewalks along the street frontages on Lots 1-3, and 5'wide concrete sidewalks through the driveways located on Lots 1-3. 7. Lots 1—3 of Prairie View Heights Second Addition in the City of Fairfax, Linn County, Iowa had previously been developed as 4 residential lots. As part of this original development,four(4) sanitary sewer service stubs and four(4)water main service stubs have been extended to these three (3) lots. The DEVELOPER agrees not to use the additional sanitary sewer service and the additional water service. The DEVELOPER shall be responsible to cut off and remove both the sanitary sewer service line at the CITY's sanitary sewer main and the water main service line at the CITY's water main, each of which are located in Larkspur Drive, at such time as notified in writing by the CITY. The services will be required to be cut off and removed at such time as the unused sanitary service and water main service stubs are determined to be leaking and/or if street or right-of-way surface problems occur and are related to the existing service stub. The DEVELOPER shall also be responsible for repairing/replacing the CITY's Right-of-way to its prior condition as part of these service removals. 8. The DEVELOPER agrees to indemnify and hold harmless the CITY for damages or claims for damages that may arise or accrue as a result of City Council approval of this Agreement. 9. This Agreement shall be binding upon the parties hereto and their heirs, successors, and assigns, and the sale by the owner of all or any part of said Lot 1 through Lot 3, shall transfer obligations of the DEVELOPER to the successor in interest.
