RESOLUTION TO PROCEED WITH THE PUBLIC IMPROVEMENTS TO
PRAIRIE CREEK ESTATES SEVENTH ADDITION IN THE CITY OF
FAIRFAX, LINN COUNTY, IOWA
WHEREAS, Plan of Improvements of Prairie Creek Estates Seventh Addition for
site grading, erosion control measures, sanitary sewer, water main, storm sewer, and
street paving, dated February 4, 2015 has been submitted to the City of Fairfax from
Legacy Land Investments, LLC and Alltrans, Inc.; and
WHEREAS, Hall and Hall Engineers, Inc. has reviewed said Plan of
Improvements for Prairie Creek Estates Seventh Addition in the City of Fairfax, Linn
County, Iowa and has the following considerations with these Plan of improvements:
1. The public improvements are in general conformance with the City of Fairfax
design standards and the Cedar Rapids Metropolitan Area Design Standards.
2. There are concerns with maintenance and emergency services to the 5 lot
subdivision as these plan of improvements are proposed.
3. There is a concern with the possibility of installing the sanitary sewer under the
proposed City Street in winter conditions.
4. Prior to any construction on the proposed site,the developer shall provide the City
with a copy of the NPDES Permit Authorization, and the fully executed SWPPP
is completed and a copy is provided to the City.
5. Prior to any construction on the proposed sanitary sewer and water main facilities,
a copy of the Iowa DNR Construction permits for the sanitary sewer and water
main are provided to the City.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, that Legacy Land Investments, LLC is hereby granted permission, "At
Their Own Risk", for their contractors to proceed with site grading, erosion control
measures, sanitary sewer installation, water main installation, storm sewer installation,
and street paving activities in Prairie Creek Estates Seventh Addition in the City of
Fairfax, Linn County, Iowa with the following conditions:
1. Prior to any construction activities on this site, the developer shall execute an
agreement with the City of Fairfax that will allow the developer to begin
construction activities on this site while the concerns with the maintenance and
emergency services and the concern with the sanitary sewer installation during
winter weather are addressed. This agreement shall hold the City of Fairfax
harmless for any rework that may result from the developer beginning
construction activities prior to these concerns being addressed. The developer
will be fully responsible for any and all changes necessary to address these
concerns.
2. Prior to any construction on the proposed site, the developer shall provide the City
with a copy of the NPDES Permit Authorization, and the fully executed SWPPP
is completed and a copy is provided to the City.
3. Prior to any construction on the proposed sanitary sewer and water main facilities,
a copy of the Iowa DNR Construction permits for the sanitary sewer and water
main are provided to the City.
BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the
Mayor and the City Clerk are hereby authorized and directed to execute said Resolution.
