HomeMy WebLinkAboutRESOLUTION NO. 2015-32 RESOLUTION NO. 2015-32 RESOLUTION TO PROCEED WITH THE PUBLIC IMPROVEMENTS TO PRAIRIE CREEK ESTATES SEVENTH ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA WHEREAS, a Plan of Improvements dated April '9, 2015, from Legacy land Investments, LLC and Ghassan EI-Farhan Halloush, PE., with Alltrans, Inc., for paving, erosion control, water, sanitary sewer, and storm sewer improvements in Prairie Creek Estates Seventh Addition to the City of Fairfax, Linn County,Iowa; and WHEREAS, Hall and Hall Engineers, Inc. has reviewed said plans and profiles for construction of said improvements in Prairie Creek Estates Seventh Addition to the. City of Fairfax, Linn County, Iowa and has recommended approval of this Plan of Improvements with the following conditions: 1. That prior to the installation of the sanitary sewer and water main on this site,the up to date Iowa DNR sanitary sewer and water main permits are obtained, and a copy submitted to the City of Fairfax. 2. That prior to performing any improvements within the Iowa DOT R,O.W., an Iowa DOT Work in the R.O.W. permit is obtained, and a copy submitted. to the City of Fairfax. 3. That prior to the acceptance of the public improvements,the developer shall install the sidewalk landings and ramps as indicated with these plan of improvements. 4. That prior to the acceptance of the public improvements,the developer shall install outlet protection at the end of the existing 48" diameter RCP to prevent erosion at this location. 5. That,prior to the acceptance of the public improvements, the developer shall install the north-south drainage Swale along the east boundary line of this subdivision. This drainage swale shall be constructed within the proposed storm water drainage casement and constructed per the detail on plan sheet C.01. This drainage swale shall also be final graded with the permanent lawn seed mix installed end established (final sodding is also an option). 6. That prior to the acceptance of the public improvements,the developer shall install a dual wall HDPE drain tile in the bottom of the north-south drainage Swale located along the back of Lots 5 through 11. This tile shall be a minimum of 8"in diameter and shall connect to the existing intake located just north of the inlet of the Second Street culvert. The the pipe shall have a granular base and, a granular envelope encompassing the entire drain tile. This file shall extend,along the bottom of this drainage Swale to a new intake that shall be installed just south of i the culvert outlet under Highway 151. Two area intakes shall be installed along this drain tile line, with one near the north end of the drainage swale.where this swale bends, and one installed approximately halfway between this bend and the existing southerly intake. The existing field tile from the field located north of the highway shall be connected into the most northerly area intake. 7. That prior to the acceptance of the public improvements, the developer shall provide the City of Fairfax with As-Built drawings of the public improvements, including cross sectional topo shots of the north-south drainage swale (one cross section at each lot). 8. That prior to the acceptance of the public-,improvements, the developer shall provide the City with.a 4 year performance/maintenance bond covering all the public improvements within the proposed development. An engineer's estimate for these public improvements shall be submitted with this bond to determine the amount of the bond. 9. That prior to the issuance of a permanent occupancy permit for the home owner(s) on Lot 11, an engineer licensed in the State of Iowa shall certify that the overflow drainage swale located along the south side of this Lot has been constructed per the approved plan of improvements, and submitted to the City of Fairfax. 10. Prior to the:issuance of a permanent occupancy permits for the home(s) located on Lots 5, 6, 7, 8, 9, 10, and 11, an engineer licensed in the State of Iowa shall certify that the 100-year flood event can be conveyed through these lots without causing damage to the structures/homes on these lots. These certifications shall be submitted to the City of Fairfax. 11. As part of the final plat for this subdivision, the storm water drainage easement shall fully encompass the 100-year storm event at the back of Lots 5 and 6. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, that from. Legacy land Investments, LLC is hereby granted permission 'for their contractors to proceed with installation of paving, erosion, control, water, sanitary sewer, and storm sewer improvements in Prairie Creep Estates Seventh Addition to the City of Fairfax, Linn County, Iowa with the following conditions. 1. That prior to the installation of the sanitary sewer and water main on this site, the up to date Iowa DMR sanitary sewer and water main permits are obtained, and a copy submitted to the City of Fairfax. 2.
